If you're talking about the witness then he tried to kill him and left him for dead on the side of the road.
So how much gooning do we know of, because to me even the evidence in the trial he got life over, was shaky at best, it seemed more talk, he was in the car with him but didn't they never find the gun ?

Nah this was for case #2. He was found guilty in case #1 and got life. He is appealing that one though but he ain't going nowhere for now except back to Shawshank.

Even with the light evidence.. take it from experience.. it is hard to get jury to not focus on a guys prior conviction... especially if the dude is currently doing time for a murder.
