His lawyers, if they're worth the thousands of dollars per hour he's paying them, had to have told him "now Aubrey, this will open you up to the same accusations, and they'll have the ability to investigate that very thing during discovery. You sure you want to go this route...?"
To me this is a very he said/she said type lawsuit, which leads me to believe that he knows way more than he's letting on... and that something is, him knowing that they do this because they did it for him.
