I thought the same thing too until I talked to my lawyer friend today about it. He said he gets these kind of situations all the time in courts. He said Cease didn't actually have to identify Kim in the video. He said the courts can't force anyone to identify anyone. He could have said he was not sure exactly who was in the video.
Not that it matters now anyways or would have made a difference.
