Video Shows Police Fatally Shoot Grandmother With Dementia In New Mexico Home
Body camera footage shows an officer shouting at the 75-year-old woman for 38 seconds before firing twice.

Police in New Mexico have released disturbing body camera footage showing an officer fatally shooting a 75-year-old woman with dementia in her home last month.
Warning to readers: The video, below, is graphic and disturbing.
The woman, Amelia Baca, had become agitated at family members in the Las Cruces home when her daughter called the police for help on April 16. According to family members, Baca was having a mental health crisis.

In body camera video released Tuesday by the city of Las Cruces in response to a public records request, an officer can be seen pointing a gun at Baca through the doorway of the home moments after arriving on the scene.

Baca, who family members said did not speak English, is holding two kitchen knives and shouting in Spanish.
The officer repeatedly shouts at her in English to “drop the knife,” “drop the fucking knife,” “do it now.” After 38 seconds, he tells her to “put the fucking knife down” and fires two shots at her.
She died at the scene.



The body camera footage begins with the officer arriving at the house. As he approaches the front door, he asks two women — Baca’s daughter and granddaughter — to step outside.
The granddaughter, Albitar Inoh, tells the officer, “please be very careful with her,” as she passes him.
Baca then appears in the doorway holding knives in each hand. He points his pistol at Baca and begins shouting for her to drop the knife.
Last month, police released a narrated video containing redacted portions of the 911 call and a very small portion of the body camera video of the officer arriving on the scene.
In the 911 call, Baca’s daughter tells the dispatcher: “I really need an officer or an ambulance or someone because my mother is getting really aggressive.”

“I’m hiding in a room because she’s threatening to kill me,” she said. She told the dispatcher her mother had dementia.
The Las Cruces police officer’s identity has not been made public. He has reportedly been placed on administrative leave.
Baca’s family announced Thursday they plan to file civil lawsuits against the city and police department. They have also demanded that the district attorney charge the officer with murder.
“Let me be blunt. Amelia Baca was executed by the Las Cruces Police Department,” the family’s attorney, Sam Bregman, told reporters, according to the Las Cruces Sun News. “As a result of this senseless tragedy, the Baca family is respectfully demanding that the district attorney charge this officer with murder.”
“You can’t walk up to someone’s front door when they’re having a mental health crisis ... and shoot them after yelling at them for 38 seconds,” Bregman said.

Shortly after the news conference, the city said in a statement that it couldn’t comment, the Sun News reported.
“First, we do not take critical incidents such as this lightly, especially when there is a loss of life,” the statement said. “We, again, extend our sympathies to the family and friends of Amelia Baca. Any loss of life, no matter the circumstances, is tragic.”
A task force of local law enforcement departments are investigating and will send findings to District Attorney Gerald Byers.

Attorney: Deputies didn't identify themselves, shot into vehicle outside Kissimmee Target

KISSIMMEE, Fla. —
The Osceola County Sheriff's Office may soon be hit with a multi-million dollar lawsuit, claiming gross negligence.
This is according to attorneys for the families of two young men shot by deputies — one was killed.

Sheriff Marc Lopez gave his comments about the death of the 20-year-old and the shooting of a 19-year-old over email.
Lopez said the deputies were not wearing body cameras because they responded from training, coming from a nearby parking lot.
It happened April 28.
Investigators said two teenagers stole a pizza and some Pokémon cards and then got into a car outside a Kissimmee Target.
Twenty-year-old Jayden Baez drove that car, according to a report.
Baez was shot and killed by deputies.
Nineteen-year-old Joseph Lowe, accused of stealing, was also shot and lost a finger.
Attorneys for Lowe and Baez's families, Mark NeJame and Albert Yonfa, said on Wednesday that the shooting should have never happened.
"Not only was the driver killed on the spot — from what we understand by a hail of bullets — but Joseph Lowe, 19-year-old Joseph Lowe, put his hands up," NeJame said.
"What does that reflect? 'Stop! I have nothing in my hands! Nothing is going on. I'm innocent', and nevertheless, he was shot three times in one hand, three times in the other, and his finger was cut off, shot off," NeJame said.
WESH 2 News asked a former police officer and professor of forensic studies at Florida Gulf Coast University, Dr. David Thomas, about the attorney's claim that deputies used unmarked vehicles to block in Baez's car.
"It should have never been allowed as soon as they got out of the store. If they were going to stop them, they should have stopped them," Thomas said.
The family's attorneys also said deputies did not announce themselves before shooting.
"I can't say on the criminal side, but I can tell from a civil side, it's going to cost. It's huge because I have the right to know who's stopping me. If they didn't have lights or sirens in the cars, that makes it even worse," Thomas said.
WESH 2 also asked about the Osceola sheriff's decision not to comment further.
"I think the reality is that they have to kind of gather the facts before they can actually release the information," Thomas said.
Thomas wanted to be transparent, but he also needed to be fair to all the parties that are involved.
Thomas wanted to point out the deputies are going through two separate investigations right now.
One investigation is from the Florida Department of Law Enforcement to see if the shooting is justified.
The other will be an internal investigation to see if they followed policy.
Thomas said because there is no body camera footage, FDLE will have to rely on the store's security footage, witnesses and any forensic evidence.

Lawyers for the man killed last year by Osceola County deputy sheriffs as he tried to leave the scene of an alleged shoplifting is preparing a lawsuit against the Sheriff’s Office, citing “excessive, unreasonable and unnecessary force.”

The pending federal lawsuit, which names Sheriff Marcos López, comes a year since 20-year-old Jayden Baez was gunned down by deputies Scott Koffinas and Ramy Yacoub, who for the first time since the incident have been publicly named.

Attorneys Mark NeJame and Albert Yonfa also claimed the Orange-Osceola State Attorney’s Office is investigating the Sheriff’s Office for its handling of the shooting. NeJame and Yonfa previously criticized OCSO as trying to engage in a cover-up, including falsifying reports.

The legal complaint will be filed in the coming days, NeJame said."
