Could legal action be taken?

I am thinking only if those 2 were separated?

There was a case here in Georgia a couple of years ago where the woman had the husband arrested for rape. Because they were married they couldn't convict him on the rape but locked him up for oral sex. It's illegal here...

A woman CAN be raped by a spouse. No means NO, even if the couple is married. Women (hopefully) are no longer considered marital property and subject to the whims of their abusive husbands.

The laws do vary state to state, but in New York, a husband can be arrested and charged with rape of his wife.

Yeah, you can be raped by a spouse and charged with a crime.

But in most states, it's not as serious a crime as regular rape.

Atlanta. I know most states find sodomy illegal too. You can do it as long as the police don't find out. If they do and decide to be pricks they can charge you.

You mean it's not taken as seriously by the authorities as other such incidents, but's there's certainly no fundamental difference in terms of the ultimate act.

Folks also seem to have a hard time believing that a prostitute can be raped. :smh:

No you dumb twat. It's a totally seperate crime in over 30 states and is less punitive than the standard definition of rape aka non-marital rape.

for better or for worse i understand why it does not hold the same weight as to raping someone on the street who you do not know or never had Consensual Sex with

No, it isn't. Consider the difference between statutory rape and "regular" rape. And then there is date rape, which is just rape in a different situation.

Also, a marriage puts a different spin on things. There are so many different factors to consider when investigating rape by spouse. It has to be viewed differently.

There are different definitions of the word rape in the eyes of the law.

Not really. Only different degrees. There are certainly other, and lesser, "sexual offenses" by law that encompass a similar act, but once you get down to the charge of "rape" it's all about sex without consent (or with someone too young to consent).

Yes Georgia has a bunch of crazy laws..Im a State Trooper here in georgia and some of these laws trip me out.. Oral sex is illeagal..so is anal Sex als its a law that you cant move to a new house or apartment on a sunday thats a damn felony! believe it or not its on the books.:eek:

You can rape a spouse even if you're married and YES legal action can be taken. Hard to prove your case. I think that husbands and wives should accomodate each other, even if they are not in the mood all the time. It makes life a little more peaceful IMO

I don't think this is about a woman just not feeling like it and then being coerced. It's more about the rape being a part of an overall physical assault or a brutal exercise of domination and control. It's a way for the abuser to engage in an act of ultimate dehumanization, particularly if it's anal rape (not unlike how males use rape to exert power in prison).

thats exactly what it is! the majority of spousal rapes take place within a marriage where spousal battery takes place the rape is just taking it to another level. sadly i know a female who was raped many times by her abusive husband and no matter how much i try to convince her otherwise she thinks that everything is permissible because they were married, i guess its just her way of justifying it. the worst part about it is that her husband even raped her once when they were separated and seeing other people.
