In 2019, an immigration judge granted him "withholding of removal" status, a rare alternative to asylum, over the threat to his life from gang violence in El Salvador if deported, and this status allowed him to legally live and work in the United States.
U.S. Immigration and Customs Enforcement, however, alleged that he was a certified gang member based on information that came from a confidential informant used by county police, records state.
According to Abrego Garcia’s attorneys in his current case, the criminal informant had alleged that Abrego Garcia belonged to an MS-13 chapter in New York, where he has never lived.
The information was enough for an immigration judge in 2019 to keep Abrego Garcia in jail as his immigration case continued, court records state. The judge said the informant was proven and reliable and had verified his gang membership and rank.
In October 2019, an immigration judge denied Abrego Garcia’s asylum request but granted him protection from being deported back to El Salvador because of a “well-founded fear” of gang persecution, according to his case. He was released, and ICE did not appeal.
Abrego Garcia checked in with ICE yearly while the Department of Homeland Security issued him a work permit, his attorneys said in court filings. He joined a union and was employed full time as a sheet metal apprentice.
A Justice Department lawyer with 15 years of experience in the federal government has been fired by the Trump administration after admitting in court that a protected Maryland resident was mistakenly shipped off to a notorious work prison in El Salvador as part of his deportations of Venezuelan migrants through the unprecedented use of an 18th-century wartime authority, which have since been blocked multiple federal judges.
Erez Reuveni was the acting deputy director for the Office of Immigration Litigation earlier this month when Trump administration officials notified him he was being placed on indefinite paid leave for comments he made during a hearing before U.S. District Judge Paula Xinis, who is presiding over the case of Kilmar Abrego Garcia. His termination from the Justice Department was first reported by The Wall Street Journal.
“The facts are conceded,” Reuveni confessed during the proceeding, which centered around Abrego Garcia being sent back to his native El Salvador without due process, in violation of a court order that he not be deported.
“Mr. Abrego Garcia should not have been removed,” Reuveni told the court. “He should not have been sent to El Salvador.”
Reuveni also appeared frustrated during the hearing, telling Xinis that one of the first things he did upon being assigned the case was ask his “clients” why they had not requested that Abrego Garcia be returned to the U.S., but was not provided with a clear answer, CNN reported.
As previously reported by Law&Crime, Reuveni was suspended following the hearing for failing to “follow a directive” from his superiors.
“He was put on administrative leave by Todd Blanche on Saturday. And I firmly said on Day 1, I issued a memo that you are to vigorously advocate on behalf of the United States,” Attorney General Pam Bondi said in a statement addressing Reuveni’s suspension. “Our client in this matter was Homeland Security — is Homeland Security. He did not argue. He shouldn’t have taken the case. He shouldn’t have argued it, if that’s what he was going to do. He’s on administrative leave now.”

This is more than just Kilmar Garcia....anymore than the protests in 2020 was ONLY about George Floyd. The peopel at the center if the issue is just the avatar of a policy/defacto behavior of fed/state/local govt that affects or potentially affects ALL OF US.
Everyone in the United States of America is protected by due process as matter of this country's constitution. Any violation of that should send shockwaves from one end to the other in this country. You have a sitting president blatantly saying he's seriously considering DEPORTING AMERICAN CITIZENS for crimes even tho he stipulates only the most seriously and violent of crimes. YET there is case where Garcia wasnt charged with much less convicted of a heinous violent crime...In fact he's committed NO violent crime in the US or El Salvador and yet he's designated a terrorist. And treated as if he DID do something the most horrible things ms-13 members have done. Not only that they ADMITTTED to the court they fucked up on sweeping him up to Ice.
