I'm just trying to brainstorm some solutions to this problem based on my review of the video tape. Another thing that could do is similar to Miranda Rights is read a prepared statement advising the person that they're continued resistance could result in permanent injury or death getting to them to acknowledge this fact.

Most of the time they remain silent, so making a statement such as we are detaining you due to reasonable suspicion that you were involved in a crime or to protect my safety, any resistance to this detainment could result in your permanent injury or death. If we believe that you were not involved in a crime then we will release you from your detainment. If we find facts to support an arrest, you will be presented in front of a judge to set bail or to remand you to jail for trial.

This could protect them from being seen as using excessive force.

This is a common thing with people that are caught committing a crime is to absolve themselves by proving criminal conduct of the accuser. The person that videotaped Eric Garner was arrested after it was released. This is something that your attorney should prepare you for if you prove your case that you may become a target in the future to bolster their PR image.

Again, my analysis is PR by law enforcement/racial opportunist to absolve themselves when a black cop does the same thing as a white cop. Hollywood immediately stepped in to bolster the image of law enforcement when they got caught on film handing out a beat down. The black opportunist got paid a pittance while we suffer. Yes. You are correct in the situation you mentioned below.

In the case someone who is NOT a threat, you used to be able to beat with your baton on the arms or legs.

You can also taze. However you are allowed to let them go.

I have seen it happen. Especially with women and children who are not a threat.

However no cop in 2023 is going to really do that. But usually it would happen with back up and a supervisor who makes the call.

They would have to have the persons info and write them a citation.

But if it is a dangerous person, you are doing down and you are going to get hurt. BAD.

What about when they have them physically restrained, yet they are unable to get handcuffs on them? If that person is involved in a murder, and they can't detain them due to their unreasonable resistance, and they pose a risk to public safety, than deadly force may be used. It would be no different than pulling a knife out.

Here with a basic traffic stop, when they were unable to restrain them, than an option that police should have is letting them go if they are unable to put handcuffs on them after detaining them and they don't pose a risk to public safety.




They used to be able to use deadly force for a fleeing suspect that poses a threat to others back in the day until the Supreme Court handcuffed them with case law. This culture of having somebody detained at all costs even for a petty traffic stop or petty theft such as George Floyd is the problem. Law Enforcement should not have to involved in WrestleMania to detain somebody.

Now you are starting to see why this guy was fired immediately from the LAPD, looking like Edward Snowden - carrying a Constitution in his pocket, affecting the PR image of white cops that shoot/beat us to death. A black police officer is supposed to see misconduct and do nothing.

He was gaslighted and he went crazy going on a shooting spree leading to him being burned alive. So we got movies and now going after black cops that report misconduct because it makes the white police officers look bad. This sham investigation was to discredit him and terminate him from his job.

If you are a black police officer, this is something you need to think about if you see some shit on the job. I don't think it is a blue wall of silence, helping build this false image of white police officers. If one of these black officer had stopped the beating, looking like a boy scout, this toxic culture would have gotten him fired.

If a police is going to detain us, we should have Miranda type rights read to us. We should also have civilian liaison or lawyer present either virtually or in person during this detainment.

We are detaining you due to reasonable suspicion that you were involved in a crime or to protect my safety, any resistance to this detainment could result in your permanent injury or death. If we believe the factual evidence gathered do not support an arrest then we will release you from your detainment. If we obtain evidence to support an arrest due to a violation of the law, you will be presented in front of a judge to set bail or to remand you to jail for trial.

I agree with all this but all American citizens technically already have Miranda rights, which includes the right not to self-incriminate and the right to an attorney, but that doesn't change how the police approach people in our community.

So those rights definitely aren't enough. De-escalation needs to be a higher priority for police. They shouldn't be approaching ppl dialed up to a 100. If the person isn't an immediate threat, which should be easy to judge, they should be able to explain why they stopped the person.

Furthermore, there needs to be rules on how physical they're allowed to get. They should be able to restrain a person without cutting off their ability to breathe and without striking them with blows. The use of deadly force should be a last resort.
