She waited 54 days before responding in that lawsuit causing the case to fall through.

Those black folks were set to receive millions, Ketanji sided with the white corporation.

Whoa hold on potna. Before you start calling her a female Clarence Thomas you should know the reasoning behind her decision. Jackson ruled that the proposed settlement was not fair, reasonable and adequate because many Black employees would be abandoning potential discrimination claims without knowing what they were giving up and what monetary compensation or other relief they were likely to get in return. Every one of Lockheed’s Black employees would have had to give up all rights to sue the company for any kind of past discrimination to obtain a settlement in this one particular case, which challenged one particular employment practice of the company. Jackson believed that trade-off was unfair.

Long story short, if the claimants took the deal, no black person could sue to company for past discrimination in the future. Besides if she is a Clarence Thomas type ask yourself why 47 out of 50 Republican Senators voted against her. :hmm:

Lock Heed Martin wanted to limit damages that could be sought from future discrimination lawsuits as part of their agreement. The Judge ruled against that. But some cats are desperately attempting to defend GOP Senator Tim Scott, even putting out half-stories, saying the Judge ruled against a against discriminated workers receiving compensation and that's why Tim Scott voted against her confirmation :roflmao: :lol:


This has already been discussed numerous times. Lockheed Martin was on some bullshit. Jackson was right:

Jackson expressed additional concern about the proposed settlement's opt-out procedure, which would make those who don't respond to the class action ineligible to receive compensation from any settlement fund.

"That is exactly the sort of circumstance that raises legitimate questions about the fairness of a settlement agreement," the ruling states.

According to the ruling, thousands of Lockheed employees are expected not to respond, which Jackson found unpalatable.

"This settlement agreement effectively allows Lockheed to inoculate itself against any and all race discrimination and race-related benefits claims by a huge swath of its African-American employees for a price that hardly seems 'adequate,'" the ruling states.

Also fam, you can tell by some of the comments in here, that there is a desperation (facts be damned) to equate her with Clarence Thomas, whose wife coordinated with insurrectionists. Also, Judge Thomas was the ONLY judge who wanted to hear Trump's stolen election joke of a case. That speaks volumes even over the other 3 judges who were rushed in.

Thank you for the additional information. Early on, nearly immediately, when it was announced she'd be Biden's pick another retired black judge came out against her and cited this case. He provided what appeared a brief of the case but either I missed this information in going over it or possibly misread the article.

That was U.W. Clemon. He was being disingenuous. It was his law firm that dropped the ball in allowing Lockheed to have an agreement that would limit the amount Black Americans who can come forward concerning discrimination litigation. Judge Ketanji called out their firm for that. Hence, his axe to grind in sending that half-truth Letter to the Biden Administration.

For just about every action, there is usually a motive behind it.

Additionally, the fact that most of the GOP Senators, except three, were against the Ketanji pick told me Biden made the right call.
