The community is continuing to rally in Tulsa a week and a half after Terence Crutcher was fatally shot by a Tulsa police officer on Sept. 16.

Law Enforcement and Supporters for Media Accountability has organized a rally from about 1-5 p.m. Tuesday in support of Officer Betty Shelby, who has been charged with first-degree manslaughter in the shooting of Crutcher.

One supporter carrying a Trump campaign sign with the words "I back the blue" penned at the bottom, said she came to the rally to support Shelby.

"A person went to work that morning, just planning to do her job that she's been doing for a long time to the best of her ability and all the sudden she's arrested for manslaughter for just doing her job," said Julia Clayton, 47, of Keystone Lake. "They're the ones trained in that situation, they're the ones that's living through it; whatever she did she thought she needed to do, and I don't think she should have been thrown in the frying pan over it until the investigation is complete."

Amanda Hall Miller, vice president of LESMA, said the Shelby case has been "really pushed" across Tulsa and in the media.

"It's not even just the media ... you've had all kinds of rallies and support rallies and things against Betty Shelby, and we think it's time to bring the dialogue forward," she said, adding that if people have concerns with policing in general, that is a conversation to be taken up with law enforcement.

Miller commended the community for keeping protests and other events peaceful, adding that the point of the event she organized is not to say police lives matter only, but that officers put themselves on the line and need the community's support.

LESMA, which Miller said has been around about a year and a half, on its website calls the Black Lives Matter movement a "hate group" and states that "for far too long the silent majority stood by and watched as the vocal minority fed their hate into the war on police in America."

The group also states it aims to hold the media accountable "for their often slanted reporting" to boost ratings and advertising revenue.

"Our mission is to defend, insulate, represent and support these brave men and women while they faithfully discharge their duties and sworn oaths," according to LEMSA's website.

Also Tuesday, the Rev. Al Sharpton and other prominent pastors and civic leaders are expected at a “National Prayer Call for Justice March” in support of Crutcher’s family.

Plans for Sharpton to attend a rally in Tulsa were publicly announced when the Crutcher family met with him in New York on Wednesday — a day before Tulsa County District Attorney Steve Kunzweiler filed the manslaughter charge against Shelby.

The event is set to begin at 2 p.m. Tuesday at the Greenwood Cultural Center, 322 N. Greenwood Ave., where attendees will begin a march that will end at City Hall, 175 E. Second St., according to a news release.

Tulsa Police Officer Betty Shelby was temporarily deaf during her encounter with Terence Crutcher, this according to her attorney, Scott Wood.

Wood said Shelby had experienced what is called “auditory exclusion”, a form of temporary hearing loss occurring under high stress. This is apparently why Shelby did not hear sirens from the additional police vehicles, she didn’t hear when Officer Tyler Turnbough arrived, nor did she hear him announce to her that he has his Taser.

Wood said Shelby is justified in gunning down Crutcher, since she believed he had a gun, and “…if you think someone has a gun, you don’t get your Taser out.” No gun was found on Crutcher, nor his vehicle, and Shelby was not responding to a call about an armed person, so her suspicion of Crutcher being armed is questionable.

Shelby was charged with felony manslaughter in the first degree, and was arrested after turning herself in to authorities. She was booked at a local county jail and released on $50,000 bond 23 minutes after her arrest.

Attorney for Terence Crutcher family calls information raised by officer's defense irrelevant

Nothing that happened before Officer Betty Shelby came into contact with Terence Crutcher is relevant to the criminal prosecution of the officer, an attorney for Crutcher’s family said in a statement Tuesday evening.

Shelby’s defense attorneys had said in a motion Monday that they have become aware of allegations that Crutcher, 40, had fired shots in the 1500 block of East 52nd Street North on Sept. 15, the day before Shelby fatally shot him on 36th Street North near Lewis Avenue.

Shelby is charged with first-degree manslaughter in his death and has pleaded not guilty. Her attorneys asked the court in Monday’s motion that the Tulsa Police Department be ordered to hold a gun it obtained Sept. 15 as possible evidence related to Crutcher’s death.

But in a response Tuesday evening, Damario Solomon-Simmons, attorney for the Crutcher family, said “nothing that occurred on or before September 16, 2016, at 7:15 p.m. is relevant to the unjustified and unprovoked shooting and killing of Terence Crutcher.”

“It is sad, but not surprising, that Officer Shelby’s counsel continues to promote irrelevant information in an attempt to distract from undisputed facts that Office Shelby shot and killed Terence Crutcher without provocation or justification,” Solomon-Simmons said.

He reiterated that Crutcher was not armed and was not making sudden movements toward officers when he was shot by Shelby. He emphasized that at the time, police were unaware of Crutcher’s criminal background.

Attorney Shannon McMurray wrote in the motion filed Monday that “Betty Jo Shelby seeks to have the firearm preserved and held for evidence so that she may have the firearm tested for possible DNA and/or fingerprints and to be held as evidence to present in her defense.”

McMurray said prosecutors can argue later about whether evidence, if any, obtained by testing the gun is admissible in court.

Shelby attorneys say witness saw Crutcher firing gun day before he was killed
Attorneys for Betty Shelby filed a motion Friday for immediate injunctive relief directing Tulsa police to hold a Glock for use in Shelby’s defense.

Shelby is the Tulsa police officer accused in the shooting death of Terence Crutcher, an unarmed black man, in Tulsa last month. She faces a first degree manslaughter charge.

Shelby’s attorneys claim they received a call from a man saying he saw Crutcher firing a gun up and down East 52nd Street on September 15.

The motion goes on to state that other 911 calls were made regarding shots being fired into the air.

Though police were called out, they did not take an official police report, because they say no crime happened. No one was arrested.

While they were out there, the motion claims they found a gun on the ground near an address of 1531 East 52nd Street North. We went out there and did not find that address. Police recovered the gun. They said it came back stolen and the owner of the gun was allowed to pick it up.

FOX23 investigated the address, and were unable to find it anywhere in the area.

Shelby's attorneys want the gun to be recovered to be tested for possible DNA and fingerprints to use in her defense.

The Crutcher family attorney, Damario Solomon-Simmons, released this statement in response:

“It is sad, but not surprising, that Officer Shelby’s counsel continues to promote irrelevant information in an attempt to distract from undisputed facts that Office Shelby shot and killed Terence Crutcher without provocation or justification.

The undisputed facts are as follows:

Fact #1. Nothing that occurred on or before September 16, 2016, at 7:15 p.m. is relevant to the unjustified and unprovoked shooting and killing of Terence Crutcher.

Fact #2. The video shows that Terence Crutcher was unarmed when he was shot and killed by Officer Shelby.

Fact #3. Terence Crutcher did not have a weapon in the car when he was shot and killed by Officer Shelby.

Fact #4. The video shows that Terence Crutcher had his hands up when he was shot and killed by Officer Shelby.

Fact #5. The video shows that Terence Crutcher did not make any sudden movements towards the officers when he was shot and killed by Officer Shelby.

Fact #6. Terence Crutcher was not a suspect for any crime when he was shot and killed by Officer Shelby.

Fact #7. Terence Crutcher was not known to be breaking any laws when he was shot and killed by Officer Shelby.

Fact #8. The video shows that Terence Crutcher was notbeing belligerent when he was shot and killed by Officer Shelby.

Fact #9. The video shows that out of the four (4) officers on the scene, only Officer Shelby had her gun out.

Fact #10. The video shows that out of the four (4) officers on the scene, only Officer Shelby shot Terence Crutcher.

In closing, we are optimistic that District Attorney Steve Kunzweiler will rely on the actual facts of this case to secure a guilty verdict and appropriate prison sentence for the tragic killing of Terence Crutcher.”

So shots were fired in air a day before by some unknown person, police show up, no reports are made because there was no crime...fast forward a day later...Shelby happens to kill the person the allegedly fired those shots in the air? Who is this witness? What is their record? Not asking because I want to throw them under the bus, but it's easy for the police to find someone with a record in that neighborhood and tell them "say you saw Terrence shooting in the air and we'll drop this drug charge." All that being said, you can't kill someone today for something they allegedly did yesterday...that is vigilante justice and police aren't supposed to be in that business.

When I first heard about this case I said she's ill equipped to handle pressure situations. Auditory exclusion for a cop. Seriously? This means when the pressure is on she hears nothing. Deaf to all that's being said around her. Its possible that during her encounter with Terence Crutcher, he may have responded to her and she simply didn't hear him. Again proving she's unfit to serve as a police officer. You can't perform your duties as a cop if you can't hear properly?

Shelby should've been charged with murder not manslaughter. Even if he was reaching for a gun she was already in position to defend herself. The kicker here is the other cop told her he had his tazer ready and did taze the guy. The fact is at that point she wasn't alone and a male officer (with the tazer) had stepped in front of her, the emergency at that point no longer existed.
