In my state -

Maryland law accounts for shared custody of a child directly in the child support formula used to calculate payment amounts. This means that, in cases where custody is shared, the amount of child support paid by the paying parent will be reduced according to the amount of time they have custody of the child.

You have primary custody and still pay child support? If you do, all I'm saying is that's not typical. If you have primary custody, why is the court ordering you to pay support? In Berry's case it's because, the court doesn't think it's fair to the child to live half the time in a mansion and the other half in a one room apartment.

I've said it many times before and I'll say it again.

Suppose you have a traditional family with a husband, wife, and two kids. Husband being the main breadwinner.

One day he comes home looks at his wife and says "honey, I don't know how to tell you this but I lost my job today."

The wife responds by making cuts to the family budget, asking for more hours at her own job, and dipping into a joint savings account to cover expenses. She accepts that the family income is going to be lower and everyone has to pull together to get through a tough time.

However, if that husband and wife are divorced it's a completely different story.

Not only are those options off the table, but you will be called all kinds of bums and deadbeats for even suggesting them. Your payment obligations stay the same unless you can afford a lawyer and take a few days off from your job search to fight in court. You can even be thrown in jail just for being broke and the day you get out you're stuck for the back child support, incarceration fees, and God knows what else even though you still don't have a job!

The government child support system is meant to go after legitimate deadbeats who run off from their families to avoid supporting their kids. If that's not you then don't get them involved. Negotiate child support with your ex outside of the system even if it means paying a bit more.

That said, if Halle Berry's situation is incredibly unfair! But if she has enough money to pay $16,000 a month and still stay rich then my sympathy is limited.

I never said shared custody never results in one parent paying support, Berry's case is proof of that, what I said is it's not typical. If parents have shared custody and one parent is ordered to pay support, it's for a reason. If parents have shared custody and both make about the same amount of money, the court isn't going to order support payments just because one parent is a man.

But I have seen courts order men to pay support to women in joint custody when the men make less money though, but without facts, I suppose its all anecdotal.

Halle Berry's long road to finalizing her divorce to Olivier Martinez is officially over … after the ex-couple hammered out a formal custody and child support arrangement that has the actress paying big bucks.

Here's the deal … back in 2015, Halle and Olivier split after 2 years of marriage. The exes have one child, 9-year-old Maceo. They had a prenup, but the case still dragged on for years because there were some unresolved issues on custody and child support.

Fast forward to August 2023 ... Legal docs were filed in L.A. County Superior Court, which officially tied up the remaining loose ends on these issues. According to the new court docs, Halle and Olivier agreed to joint legal and physical custody of Maceo.

The docs also say Maceo will attend individual and family counseling. Halle and her daughter, Nahla, (from her ex-boyfriend Gabriel Aubry), can sit in during the family sessions. But Halle’s current boyfriend, Van Hunt, is not allowed to participate.

Halle will have custody of Maceo Monday to Wednesday and Olivier will get him Wednesday to Friday, with some variations due to school closures. The pair will alternate custody of Maceo on the weekends.

As for child support, Halle has to pony up $8,000 a month to Olivier. She will also pay an additional 4.3 percent of all income she receives above $2 million.


It doesn’t stop there … Halle must also cover Maceo's private school tuition and 100 percent of his extracurricular activities, including soccer. She's also on the hook for Maceo's health insurance -- both medical and dental -- as well as any uninsured expenses.

Good thing Halle is a successful actress. Seems like she's gonna need the extra cash.

Halle Berry’s ex-husband Olivier Martinez’s legal team are demanding the actress’ emergency motion in court be shut down, In Touch can exclusively reveal.

According to court documents obtained by In Touch, his lawyers asked that Halle’s motion to force Olivier to resume coparenting therapy sessions be denied.

Halle filed docs this week claiming Olivier had failed to follow their coparenting agreement. The exes share a 10-year-old son Maceo.


The actress claimed Olivier decided he wanted to take the “summer off” and didn’t want to attend sessions until September.

She said he told her he was traveling around France in July and had plans with his brother. Halle demanded Olivier be forced to stick with the therapy schedule they worked out initially.

The deal said they would finish six joint sessions by June 14.

In addition, Halle said the therapy sessions are conducted via zoom, so he can attend wherever he is.

Her lawyer said, “It should never be necessary to seek judicial intervention solely to compel a party to comply with their own agreements. A person’s word – particularly those that become contractual obligations and then orders of the Court – should carry weight and have meaning. Unfortunately, that has not been the standard upheld by Respondent, Olivier Martinez, in this case. To the contrary, he has chosen to repeatedly violate agreements and court orders with careless disregard. To him, the terms of the parties’ stipulated court orders are simply suggestions to follow when it benefits him and which he ignores when it does not fit his alienation agenda.”



The lawyer added, "Olivier’s conduct harms the parties’ son, Maceo, causes further damage to the parties’ already strained relationship and forces Petitioner, Halle Berry, to incur unnecessary attorney’s fees to constantly seek relief from the Court.”

Halle said in a declaration, “I have tried to resolve these issues directly with Olivier without involving our lawyers – Olivier refused my efforts. My lawyer, Marina Beck, tried to resolve these issues directly with Olivier’s now third lawyer for weeks but her efforts were ignored and later refused.”

She said she needed the court’s immediate intervention. Olivier’s lawyer asked that the requests be denied due to “lack of imminent harm.”

The legal team said, “We do not consent to the orders requested as we are unable to reach our client and ask that the ex parte be set as fully noticed Motion.”

They argued, “[Halle’s] request does not comport with the purposes for which emergency orders may be granted, and [Halle’s] request does not present any emergency or exigent circumstances.”

His lawyers added, “[Halle] knowingly noticed her ex parte request when she knew Olivier] would be traveling and would be unable to communicate with his counsel to respond to [Halle’s] ex parte request, thus further impeding [Olivier’s] right to be heard.”

“Halle] is constantly attempting to harass and strong-arm [Olivier] by forcing him into 'submission' using her wealth, and the legal professionals at her disposal,” his team said. “At the same time, she has refused to agree to provide a fee contribution toward [Olivier’s] legal fees incurred, which does the absolute opposite of leveling the proverbial field.”

The legal team continued, “This ex parte application is just another example of this relentless tactic given that, when [Olivier’s] counsel asked that this be trailed for 48 hours (from July 29 to July 31) as her client is unreachable, [Halle] failed to grant [Olivier] this common and expected courtesy.”

A judge has yet to rule.
