I dont think its a crime to be sleeping or even passed out in your car.

I don't know what exactly happened because I saw one article saying she was in the car, another say she was found laying down outside on the ground beside the car.

Then we don't know what 'naked' means. Does it mean she was topless or did she just have on a dress/skirt pulled up, asleep, and she had on no draws like most women do, commando.

I'm giving her the benefit of the doubt...

You can still be charged because basically, you got there somehow.

But seriously, if you are found behind the wheel, or keys in the ignition and so forth you can still be charged with DUI because it can be argued that you intended to. It may not stick in the trial, but you are at least going to get charged. This is why it's said that if you have to sleep it off, you better not do it in the drivers seat or with the keys somewhere you can easily reach and drive away.

There was a case in VA where the dude was passed out on his couch and the cops came in and charged him with DUI. Crazy shit.

I had a partner back in the day who got out of a DUI on some smooth ass shit.

As many of you know, a lot of us don't know that we are actually intoxicated until AFTER we leave where we're at and before we get where we are going. We think we cool and we start driving and....WHOA! I can't make it.

So my dude got a bright idea, concocted the story and threw the keys out of the passenger side window. He got in the passenger side of the car and went to sleep

Just as he knew would happen, a cop rolled up. The cop asked him what he was doing here and the cops said he was driving while intoxicated. My partner said, I'm in the passenger seat I'm not driving and never was.

The story he used was, he left the bar with this chick. He was drinking and she wasn't. He was on his way home with her with her driving and he couldn't remember what her name was. She got pissed off, pulled the car over, called her friend to pick her up , her friend picked her up, she threw the keys and left him there

The cop heard the story and gave him the side eye like he didn't believe them, but there were no keys in the ignition

The cop got out his flashlight, searched the area for the keys and found the keys. He gave my friend the keys and said, "It is 1:30 in the morning. My shift doesn't end until 7:30. I'm going to drive by here once an hour. If I drive by here and you're not here you are going to jail for driving under the influence. Do you understand me?"

My friend nodded his head , put the keys in his pocket and to the cops word, once an hour the cop drove by, knocked on the window and unfortunately woke my friend up once an hour but did not arrest him.

At 8 the next morning my friend drove home and that was it. But the cop could not give him a DUI because the keys were not in the ignition

Don't set them outside the door on the ground. If you have to, place them in the grass (so you know how to find them later) that's a reasonable trajectory from the car window.
