I can't remember what the source was, but there was at least one account floating around that amounted to saying that Baldwin was horsing around basically did something along these lines. If true, even with whatever else may have gone on, he should definitely be accountable for that.
All depends on the 11 year old. As a child I hunted at that age and have friends who kids have their own rifles and shotguns at that age....what matters is what they are taught.





And that is the question that no one is answering, and that I have been asking since the first day...'why was he pointing the gun at her'. She was not an actress so under what circumstances could the gun been pointed at her???

I heard and explanation this morning that could be plausible and that is that they were shooting a scene where the gun was being fired at the camera lens....and I can visualize that shot on screen, because I realize I have seen it before and it would also explain how the cinematographer would be in the line of fire.

Figured it was going to be one of those"cool" shots where the character fires the gun at the camera,then they show the CGI bullet travelling towards the target

Baldwin stated multiple times that he could not comment on the active investigation but reiterated he has been in contact with Hutchins’s family. Alec mentioned firearm safety on film sets, stating that “there are incidental accidents on film sets from time to time, but nothing like this.” Baldwin spoke about being an advocate for tightening safety measures during production and how he is not an expert on this topic. When a member of the paparazzi forgot Hutchins’s name, Hilaria Baldwin criticized them for not knowing her name. “If you’re spending this much time waiting for us, you should know her name. Her name is Halyna,” Hilaria said. He also stated that he doesn’t believe production on the film would resume any time soon and refused to answer any questions about his future projects, wanting to keep the focus on the late Hutchins.

EXCLUSIVE: Dave Halls, the first assistant director of Rust, is not a DGA member, even though the film was being produced in New Mexico under a DGA contract.
Halls, who the Santa Fe Sheriff’s Department has identified as the person who handed Alec Baldwin the gun that shot and killed cinematographer Halyna Hutchins on the Bonanza Creek Ranch set last week, is what’s commonly known as a “financial core” non-member – or an “agency fee paying non-member” – meaning that he either chose not to join the DGA or had resigned his membership. Joel Souza, who was wounded by the same bullet that killed Hutchins, is a DGA member.



DGA rules require that “If you are an Assistant Director, Unit Production Manager, Associate Director, or Stage Manager, you must take Safety Pass Training.” And though Halls is not a DGA member, safety records show that he has completed both “Mandatory DGA Safety Training” and “Covid-19 Prevention Training.” Halls’ attorney did not return calls for comment.

Financial core status is rare in the entertainment industry. The U.S. Department of Labor defines agency fee paying non-members as “those who make payments in lieu of dues to the reporting labor organization as a condition of employment under a union security provision in a collective bargaining agreement.” The DOL also notes that “agency fee payers are not considered members of the labor organization.”
Financial core non-members – aka “fi-core,” or agency fee payers – pay only that portion of union dues that goes directly toward covering the costs of collective bargaining, contract enforcement and contract administration, but don’t have to pay that portion of dues spent on lobbying or political activities. Some workers in the entertainment industry have gone “fi-core” so they can work on non-union shoots, but others have done so for political or personal reasons – they either don’t like unions in general or don’t want to pay for their union’s political activities. They can’t vote in union elections or run for union office, but they can work on non-union shows and cross picket lines during strikes without being sanctioned by the union they have quit.
SAG-AFTRA says on its website that those who opt for financial core status “are viewed as scabs or anti-union by SAG-AFTRA members, directors, and writers – most of whom also belong to entertainment unions.”



Halls had previously been fired from the set of another indie film, Freedom’s Path, in 2019 after producers said a crew member was injured when a gun was “unexpectedly discharged.” “Halls was removed from set immediately after the prop gun discharged,” the Rocket Soul Studios producers told Deadline, adding that “Production did not resume filming until Dave was off-site. An incident report was taken and filed at that time.”
The veteran assistant director’s previous credits include The Crow: Salvation, 2003’s The Matrix Reloaded, the upcoming Dolph Lundgren starrer Castle Falls and Blumhouse TV’s anthology series Into the Dark.

Hannah Gutierrez-Reed, the armorer for the Western film Rust, is speaking out after the discharge of a firearm being used as a prop fatally shot cinematographer Halyna Hutchins and wounded director Joel Souza last week.
In a statement provided to EW by her lawyers Friday, Gutierrez-Reed, who was responsible for weapons on the Santa Fe, N.M., set, maintained that there are "untruths that have been told to the media" and that she is "devastated and completely beside herself over the events that have transpired."
According to information provided to authorities by Souza, as cited in affidavits obtained by EW, the deadly incident occurred when actor and producer Alec Baldwin was rehearsing a scene last Thursday, and was told by assistant director Dave Halls that the gun — one of three props that had been set up by Gutierrez-Reed — was "cold," meaning it did not contain live rounds. Per the affidavit, which was issued as part of a search warrant application, the AD "did not know live rounds were in the prop-gun" when he said this. The rehearsal then involved Baldwin "cross drawing his weapon and pointing the revolver towards the camera lens." The gun fired, striking Hutchins and Souza.

The statement from Gutierrez-Reed's attorneys, Jason Bowles and Robert Gorence, said, "Safety is Hannah's No. 1 priority on set. Ultimately this set would never have been compromised if live ammo were not introduced. Hannah has no idea where the live rounds came from."

It added: "Hannah was hired on two positions on this film, which made it extremely difficult to focus on her job as an armorer. She fought for training, days to maintain weapons and proper time to prepare for gunfire but ultimately was overruled by production and her department. The whole production set became unsafe due to various factors, including lack of safety meetings. This was not the fault of Hannah."
Gutierrez-Reed and her legal team said they would address "more of these rumors and the whole incident" in a statement next week.
They also said Gutierrez-Reed "would like to extend her deepest and most sincere condolences to the family and friends of Halyna," calling the late cinematographer "an inspirational woman in film who Hannah looked up to."
Gutierrez-Reed, 24, is the daughter of veteran armorer and gun coach Thell Reed. She said on the Voices of the West podcast in September that she had just completed her first movie as head armorer on another Western, The Old Way, set for release next year. "You know, I was really nervous about it at first, and I almost didn't take the job because I wasn't sure if I was ready, but doing it, it went really smoothly," she said.

In a press conference Wednesday, Santa Fe County Sheriff Adan Mendoza and Santa Fe District Attorney Mary Carmack-Altwies said that authorities recovered 500 rounds of ammunition (including a mix of blanks and possible live rounds) and three firearms, including the one discharged by Baldwin, from the Bonanza Creek Ranch set. They also have the lead projectile recovered from Souza's shoulder when he received medical treatment. (Souza has since been released from the hospital.)
Mendoza and Carmack-Altwies said the investigation is ongoing and "all options are on the table" with regard to possible charges being filed, though none have been filed at this time.
For his part, Baldwin addressed the tragic incident on social media late last week.
"There are no words to convey my shock and sadness regarding the tragic accident that took the life of Halyna Hutchins, a wife, mother and deeply admired colleague of ours," Baldwin tweeted. "I'm fully cooperating with the police investigation to address how this tragedy occurred and I am in touch with her husband, offering my support to him and his family. My heart is broken for her husband, their son, and all who knew and loved Halyna."

“I believe that somebody who would do that would want to sabotage the set, want to prove point, want to say that they’re disgruntled, they’re unhappy," attorney Jason Bowles said. "And we know that people had walked off the set the day before."





















If they use this as a defense theory, then they will have to convince a jury that the people who walked off of the set over safety concerns left behind a live round on purpose, creating possibly one of the most dangerous possibilities on set, just for the sake of sabotage. It's a good theory if someone is trying to look for a weak excuse to create reasonable doubt, but I have a hard time believing that's what they would do.

Halyna Hutchins' family sues Alec Baldwin and more crew over Rust shooting

A wrongful death suit has been filed against Baldwin and more production members in New Mexico.

The family of cinematographer Halyna Hutchins has filed a wrongful death lawsuit against Alec Baldwin and other crew members of Rust following her death on the New Mexico set four months ago.
Her husband, Matthew Hutchins, filed a complaint on behalf of himself and their 9-year-old son, Andros, on Tuesday, claiming Baldwin "recklessly shot and killed Halyna Hutchins on the set of the movie Rust." Attorney Brian Panish announced the lawsuit in a press conference in Los Angeles, alleging that Baldwin and "others responsible for the safety on set" led to Hutchins' "senseless and tragic death."
"Halyna deserved to live," reads the complaint, which was obtained by PEOPLE. "The Defendants had the power to prevent her death if they only held sacrosanct their duty to protect the safety of every individual on a set where firearms were present instead of cutting corners on safety procedures where human lives were at stake, rushing to stay on schedule and ignoring numerous complaints of safety violations."

Hutchins' family is suing for negligent, intentional, willful, or reckless misconduct resulting in wrongful death and loss of consortium. They're asking for compensatory and punitive damages to be determined at trial.

Aaron Dyer, an attorney for Baldwin and other producers of Rust, responded to the lawsuit in a statement issued to EW, asserting that "any claim that Alec was reckless is entirely false."
"Everyone's hearts and thoughts remain with Halyna's family as they continue to process this unspeakable tragedy," Dyer said. "We continue to cooperate with the authorities to determine how live ammunition arrived on the Rust set in the first place."

In October, Baldwin accidentally shot Hutchins and director Joel Souza during a camera test at the Bonanza Creek Ranch set in New Mexico. Hutchins died from her injuries after being airlifted to a hospital; Souza survived.

According to an affidavit from the sheriff's department, approximately 300 live rounds were recovered on set following a search warrant, renewing conversations about workplace safety and the use of firearms on set. The shooting unfolded hours after half a dozen camera crew workers were replaced by nonunion workers who had walked off set to protest unsafe working conditions, the Los Angeles Times reported.
After Panish announced the suit Tuesday, he and his firm presented a video featuring a 3-D animated rendering of the shooting, as well as a video showing messages among crew complaining about the safety on set. Panish alleged that industry safety standards were disregarded on set, adding, "Had they been followed, this never would have happened."
In response, Dyer denied the assertion, arguing, "He [Baldwin], Halyna and the rest of the crew relied on the statement by the two professionals responsible for checking the gun that it was a 'cold gun' – meaning there is no possibility of a discharge, blank or otherwise."
"This protocol has worked on thousands of films, with millions of discharges, as there has never before been an incident on a set where an actual bullet harmed anyone," Dyer added. "Actors should be able to rely on armorers and prop department professionals, as well as assistant directors, rather than deciding on their own when a gun is safe to use."

Baldwin and the production are also facing other lawsuits: Chief electrician Serge Svetnoy and script supervisor Mamie Mitchell have both filed their own suits pertaining to negligence on set. Baldwin's attorneys are currently pursuing a dismissal of Mitchell's lawsuit.
In his first interview following the incident, Baldwin insisted to ABC News that he "didn't pull the trigger," telling journalist George Stephanopoulos that he felt remorseful, but absolved himself of fault.
"No, no. I might have killed myself if I thought I was responsible, and I don't say that lightly," Baldwin said, adding that the shooting has taken a toll on him. "I go through my day, and I make it through the day. Then I collapse at the end of the day. Emotionally, I collapse."
Baldwin met with Matthew and Andros in Sante Fe shortly after the shooting. Matthew confirmed to the Daily Mail that he had spoken with Baldwin, whom he described at the time as "being very supportive." Baldwin spoke about meeting Matthew during his interview with ABC News, saying, "I didn't know what to say. He hugged me and he goes, 'I suppose you and I are going to go through this together.' And I thought, 'Well, not as much as you are.'
"I told him, I said, 'I don't know what to say; I don't know how to convey to you how sorry I am and how I'm willing to do anything I can to cooperate.'"
The Sante Fe Sheriff's Office has not yet charged anyone in the incident.

That lawsuit was inevitable, I'd be shocked if there isn't a settlement.

No way in hell they want her family in front of a juror, and the press coverage would be brutal.

And it being New Mexico they'd probably allow cameras in the court room which wouldn't be a good look.

The fact that the amount they're suing for isn't mentioned leads me to believe that the point of this is to force a settlement.

The husband of killed Rust cinematographer Halyna Hutchins has called Alec Baldwin’s account of the tragic incident "absurd." Hutchins died late last year on the set of Baldwin’s independent western, Rust, when a live round discharged from a pistol that the veteran actor was holding and struck her in the torso. The incident also injured the film’s director, Joel Souza, who has since recovered. But as lawsuits continue to be filed over the Rust disaster, it still remains unknown who exactly was responsible for such a horrific accident.

Shortly after the incident made news, it was Baldwin who was seen as the key figure. News outlets circulated photos of the 63-year-old beside himself with grief as he voluntarily spoke with police investigators in New Mexico. In the days that followed, Baldwin even met with Hutchins’ widow Matt Hutchins and their 9-year-old son for breakfast, leading many to conclude that the star was taking the only steps he could toward some form of atonement. But as more time passed, Baldwin began to change his approach to the situation. Rather than continuing to offer up his deep regret and sadness over what had occurred, he began to distance himself from the entire incident, stating that he did not pull the trigger on the gun or even point it in Hutchins’ direction. This hasn’t sat well with the Hutchins family, who recently filed a lawsuit against Baldwin and several other producers from the film.

Now, in the wake of revelations that the Hutchins family would be taking Baldwin to court, Matt Hutchins has admitted the anger that he feels toward Baldwin. Naturally, Hutchins does not buy into Baldwin’s assertion that he bears no responsibility for the gunshot wound that killed his wife. He’s also upset about how the entire production was handled – something that Baldwin also bears a certain amount of responsibility for as a producer. As Sky News reports, Hutchins hit out at Baldwin’s previous claims, calling them "absurd." Read the full quote below:


"The idea that the person holding the gun and causing it to discharge is not responsible is absurd to me. But gun safety was not the only problem on that set. There were a number of industry standards that were not practised and there's multiple responsible parties.”


To date, Baldwin still denies that the Rust film set was an unsafe one, yet he can’t explain why it was that a live round was placed into a real gun and permitted to be handed to him. The entire incident has been a much needed wake up call for Hollywood, with Dwayne Johnson stating that he will no longer allow real guns on any of his film sets. This sentiment has been shared by other Hollywood productions, including The Boys showrunner Eric Kripke and ABC’s cop drama, The Rookie. The idea that real guns need to be used on film and television sets is seriously being questioned and for some, it feels long overdue.


It’s extremely unfortunate that a mother, wife and talented cinematographer had to lose her life for the film and television industry to take notice of this highly questionable practice. It’s also more than a little troubling that throughout all of this, Baldwin has seemingly been more concerned about himself than the tragedy his Rust production caused. Straight from the beginning, it was somewhat obvious that lawsuits would be filed, and as the production’s general lack of safety increasingly becomes established, more lawsuits are a likelihood.

In her first public appearance since cohosting the 94th Academy Awards a week ago, Schumer again addressed the now-infamous slap Will Smith delivered to Chris Rock's face during her stand-up show at the Mirage Theater in Las Vegas over the weekend, according to The Hollywood Reporter.
"I was kind of feeling myself… and then all of a sudden, Ali was making his way up," Schumer joked, referencing Smith's role as boxer Muhammad Ali in the 2001 historical drama film, Ali. "And it was just a f---ing bummer."
After calling the incident "really sad," and adding that she thinks "it says so much about toxic masculinity," Schumer added, "I think the best way to comfort ourselves would be for me to say the Oscar jokes that I wasn't allowed to say on TV."

The cut jokes included a jab at Joe Rogan and a barb about the sexual misconduct allegations against James Franco. She also made a feeble crack about the fatal tragedy on the set of Alec Baldwin's Western, Rust: "Don't Look Up is the name of a movie, more like don't look down the barrel of Alec Baldwin's shotgun," she said. "I wasn't allowed to say any of that, but you can just come up and [slap] someone."

During rehearsals for Rust in October, a prop gun wielded by Baldwin discharged a live round that killed cinematographer Halyna Hutchins and wounded director Joel Souza. Baldwin had been told the gun was "cold," or unloaded. In an interview with ABC News in December, the actor insisted he didn't pull the trigger.

Hutchins' family filed a wrongful death lawsuit against Baldwin and other crew members in February, alleging that Baldwin and "others responsible for the safety on set" led to Hutchins' "senseless and tragic death." Hutchins' husband, Matthew, filed the complaint on behalf of himself and their 9-year-old son, Andros, suing for negligent, intentional, willful, or reckless misconduct resulting in wrongful death and seeking compensatory and punitive damages.
An attorney for Baldwin and other film producers said in a statement to EW at the time that "any claim that Alec was reckless is entirely false." Dyer added, "Everyone's hearts and thoughts remain with Halyna's family as they continue to process this unspeakable tragedy. We continue to cooperate with the authorities to determine how live ammunition arrived on the Rust set in the first place."
Schumer, who cohosted the Oscars with Regina Hall and Wanda Sykes, previously spoke about the Oscars slap two days after the ceremony, writing on Instagram that she was "still triggered and traumatized" by the incident. "I'm still in shock and stunned and sad," she added. "I'm proud of myself and my co-hosts. Waiting for this sickening feeling to go away from what we all witnessed."
About a week after the Oscars telecast, Smith announced his resignation from the Academy. It came after the organization launched an investigation into the slap to explore further action and consequences, including suspension, expulsion, or other sanctions permitted by the Academy's bylaws and standards of conduct.
"The list of those I have hurt is long and includes Chris, his family, many of my dear friends and loved ones, all those in attendance, and global audiences at home," Smith said in a statement provided to EW. "I betrayed the trust of the Academy. I deprived other nominees and winners of their opportunity to celebrate and be celebrated for their extraordinary work. I am heartbroken. I want to put the focus back on those who deserve attention for their achievements and allow the Academy to get back to the incredible work it does to support creativity and artistry in film."
