UPDATED: “Jussie [Smollett] will NOT be returning to ‘Empire,'” series co-creator Lee Daniels said Tuesday.

Daniels was responding to a Variety report in which multiple production sources said that “Empire’s” writing staff was breaking ideas for the show’s sixth and final season with the expectation that Smollett would appear in the back half of the 18-episode season.

This is the first public acknowledgment that Smollett will not return for the final season of the Fox drama series. He was written out of the final episodes of the show’s fifth season following severe backlash stemming from accusations the actor and musician faked a hate crime against himself earlier this year in Chicago.



The same production sources also note tensions were ratcheted up on set between the show’s primarily black cast members, who still believe Smollett is innocent, and the mostly white below-the-line crew, many of whom believe Smollett is guilty.

Fox Entertainment and 20th Century Fox Television declined to comment.

Multiple “Empire” cast members penned a letter back in April that was sent to multiple Fox executives and series executive producers. “Together, as a united front, we stand with Jussie Smollett and ask that our co-star, brother and friend be brought back for our sixth season of ‘Empire,’” the letter read. It was signed by “Empire” stars Taraji P. Henson, Terrence Howard, Bryshere Y. Gray, Trai Byers, Gabourey Sidibe, and Nicole Ari Parker.

When the sixth season renewal was announced in April, Fox Entertainment and 20th Century Fox Television said that they had extended Smollett’s option for Season 6 but that there were no plans for him to return. Two weeks later, Fox announced that the sixth season would be the show’s last. Prior to the events of this year, Smollett was a key cast member on “Empire.” His character, Jamal Lyon, is loosely based on Daniels.

Smollett claimed that he was the victim of an assault which he said was racially and politically motivated, as well as homophobic. Later he was accused of hiring the men who attacked him and indicted for filing false statements. The criminal charges were dropped in March, and Smollett has maintained his innocence, but the city of Chicago has filed a $130,000 lawsuit against Smollett in order to recoup the cost of the police investigation.

The records in Smollett’s case were originally sealed, but a judge ordered in May that thousands of pages of documents on the case be released. Among the documents released were police statements from the Osundario brothers, who claimed that Smollett paid them to stage the attack, as well as text messages from the office of Cook County State’s Attorney Kim Foxx.

As Variety previously reported, Foxx has faced criticism for her office’s handling of the Smollett case. In the newly released messages, Foxx discusses recusing herself from the case, which she says was based on a false belief that she was related to Smollett.

Another batch of documents is due to be released later this week. Approximately 70 hours of surveillance videos and bodycam footage that was collected by Chicago detectives during the course of the investigation is also expected to be released to the public.

A couple of 911 calls from the night of Jussie Smollett's alleged attack have been released by the city of Chicago.

An unidentified man who claimed to be an employee for the "Empire" star called authorities on Smollett's behalf on Jan. 29, after the actor alleged that he was targeted in a racial and homophobic attack.

The caller was reluctant to identify Smollett and noted that the actor didn't want to call the police following the alleged incident.

"I just need the police to come by, I work for an artist. I don’t really want to say his name," the caller told the 911 operator. "(Smollett) states that … he went to Subway and he was walking by and some guys, they jumped him or something like that. I just want to report it and make sure he’s all right."

Smollett told investigators he was beaten by two masked men who shouted racial and homophobic slurs, wrapped a rope around his neck and poured bleach on him. He also said the assailants yelled, "This is MAGA country," a reference to President Donald Trump's 2016 campaign slogan.

In February, Smollett was arrested and charged with filing a false police report after authorities said the incident was a hoax staged by the actor. Prosecutors unexpectedly dropped the 16-count indictment against Smollett in March.

The tapes were released one day after "Empire" co-creator Lee Daniels revealed that Smollett would not return for the sixth and final series of the Fox drama.

    Two days after the alleged attack, Chicago police released surveillance images of two people they said they considered persons of interest in the attack.

    The dozens of hours of video have been released by police after an open records request from the I-Team and ABC News, among others. The video includes many surveillance camera recordings of the areas where Smollett claimed he was attacked by two men sporting Make America Great Again hats.

    But the investigation turned on the actor as it continued. Chicago police said he orchestrated the attack with the help of the Osundairo brothers, who he knew. One brother was an extra on "Empire" and the other was Smollett's personal trainer.

    Police said Smollett staged the attack at a corner where he believed a surveillance camera would capture the attack, and that the facial injuries he sustained were likely self-inflicted.

    Police initially charged Smollett with one count of disorderly conduct for filing a false police report. A grand jury then returned an indictment for 16 counts of disorderly conduct for filing a false police report.

    All charges against Smollett were dropped in late February in exchange for community service and forfeiture of his $10,000 bond payment. That decision is already under a separate review by the county's inspector general.

    The ABC7 I-Team is combing through the files, and will have the latest updates on ABC7Chicago.com and ABC7 Eyewitness News.

"Are we ever going to find out the truth?" co-host Juan Williams asked his co-hosts, trying to digest the latest footage released from the case.


"We know the truth, Juan. He staged the attack," co-host Jesse Watters responded.

Chicago police released hundreds of files and nearly 70 hours of video footage on Monday from the investigation including police body-cam footage of Smollett -- with his face blurred -- wearing a white rope that he told detectives his attackers looped around his neck.

When one of the officers asked Smollett if he wanted to take the rope off of his neck, the 37-year-old actor did while stating: "Yeah. I do. I just wanted you all to see it."

The "Watters' World" host then jokingly suggested the actor tried to do a little too much with the alleged attack.

"You have MAGA insults, you have a noose, you have bleach and you have a beat down. Pick one. You don't need all of them for the hate crime," Watters said.

"It's nonsensical. It's like if you escape from a kidnapping, do you keep the ropes around your wrists to show the cops you are tied up? No. It doesn't make any sense at all."

Fox Business' Kennedy criticized Smollett for prolonging the controversy by not addressing it.

"But if he had just come out and said something, all of this would've gone away. The FBI and Chicago P.D. and even retired judges in the state wouldn't be sitting there going this is not right and we cannot have the world thinking that this is how we need our justice in Chicago and in Illinois," Kennedy said.

In the days after Jussie Smollett said he was the victim of a racially motivated attack, there was a spike in interest in his story.

Earlier this week, the Chicago Police Department released thousands of investigative files related to the case. Among the documents is an extensive online search history with a hand written note on top of several pages.

The notation was made by a member of the Chicago Police Department and reads “Smollett Search.”

The search history reveals “Jussie Smollett” was searched more than 50 times in the days following the reported attack. CBS 2 initially reported that Smollett searched himself. However, after questions were raised by Smollett’s attorney, we have verified that the search results are from one of the Osundairo brothers.

On January 29 Chicago police opened a hate crime investigation after Smollett said he was attacked near his Chicago apartment. According to police, Smollett said two men approached him around 2 a.m., shouted “racial and homophobic slurs,” poured an “unknown chemical substance” on him and wrapped a noose around his neck.

Police later said that Smollett staged the attack with two brothers, Ola and Abel Osundairo, and charged him with filing a false police report. Those charges were later dropped by Cook County State’s Attorney Kim Foxx.

On Monday, video for the first time showed Smollett with a noose around his neck as police entered Smollett’s downtown apartment. He is seen in a red and white sweater with the rope around his neck. He told investigators he kept the rope there to show them evidence of a racially motivated attack.

As the officers arrive, Smollett removes the rope and says, “There’s bleach on me.” A few seconds later he asks police to turn off the body cam.

Chicago police also obtained text messages between the brothers and Smollett, including one that apparently ignited the plan.

“Might need your help on the low,” Smollett texted. “You around to meet up and talk face to face?”

After the attack, Abel Osundairo texted Smollett, expressing sympathy as news began to spread

“Bruh say it ain’t true. I’m praying for a speedy recovery. Sh** is wild.”
