Bryshere Gray was sentenced to spend 10 days in an Arizona county jail after pleading guilty to assaulting his wife.
The Empire actor, 27, entered a guilty plea to the charge of aggravated assault in February, about seven months after he was first arrested for strangling his wife, according to court documents obtained by PEOPLE.
The other related charges against him, including aggravated assault with a deadly weapon and kidnapping, were dropped, per his plea agreement.
In addition to his 10-day jail stay, Gray will have to complete three years of probation with various conditions, documents from his March 31 sentencing hearing show. He was ordered to not drink any alcohol for the duration of his probation and to not have any contact with the victim in any form, unless approved by the Adult Probation Department in Arizona.

Gray, best known for portraying Hakeem Lyon on Empire, the brother of Jussie Smollett's character, was first arrested in Goodyear, Arizona, on domestic battery charges on July 13.
Police responded to a 911 call around 10:15 p.m. the previous night "that an adult female victim had been allegedly assaulted at her Goodyear home by her husband, who she identified as Bryshere Gray, an actor on the TV series Empire," according to a press release by the Goodyear Police Department.

Gray was later taken into custody after allegedly initially refusing to come out of his residence and speak with officers. He was ultimately arrested "without incident," police said.

Actor Jussie Smollett's trial for allegedly staging hate crime to begin Monday

The criminal trial for actor Jussie Smollett is slated to begin on Monday, nearly three years after the former "Empire" star allegedly staged a hate crime.

Smollett, 39, was charged with six counts of felony disorderly conduct for filing a false police report after allegedly arranging a hate crime against himself.

The actor claimed that he was hit by two men in Chicago in January 2019, and that they tied a noose around his neck and shouted racist, homophobic and pro-Trump rallying cries. However, investigators found that the two men who allegedly performed the attack were brothers who knew the actor, according to The Wall Street Journal.

The actor pleaded not guilty to staging the attack in February 2020. Jury selection is slated to begin on Monday.

Smollett faces up to three years in prison, though some experts have said that if the actor is found guilty he will likely avoid jail time and be placed on probation and perhaps given community service, according to The Associated Press.

Smollett allegedly recruited Abimbola Osundairo, an acquaintance of his, to carry out the attack because the actor was frustrated over his pay, according to the Journal.

Smollett reportedly paid the men who attacked him a $3,500 check to split, which was deposited in their bank accounts the day before the attack.

The two men attacked Smollett a little after 2 a.m. on Jan. 29, 2019, which prompted the actor to file a police report that is now believed to be false.

Smollett's trial was delayed a number of times after the charges against him were dropped then refiled, and following a probe into Cook County State Attorney Kim Foxx's handling of the case, according to the Journal.

Foxx is said to have communicated with someone from Smollett's family in the early part of the investigation, according to the AP, which prompted her to recuse herself from the case. After that, however, her office suddenly dropped the charges.

The COVID-19 pandemic also reportedly contributed to the trial's delay.

Smollett is also the target of a civil lawsuit brought by the city of Chicago, which is taking issue with the large costs it incurred looking into the allegedly fake hate crime, according to the Journal. The lawsuit is asking the actor to pay costs, damages and attorneys' fees associated with his case.

A Chicago official told the Journal that the lawsuit, which was moved from local court to federal district court in 2019, has been stayed pending the criminal trial.

He was accused of faking his attack in 2019, at that time the he claimed he did not fake anything and at that time the DA chose not to prosecute, but in FEB 2020 a special prosecutor renewed the case with six counts of disorderly conduct and filing a fake police report.

He still claims he is innocent. Thus the courts gone try to prove it. It should be over in a week.

His problems are way past just being gay I think he has some serious mental issues...he prolly gone roll out the courtroom like this...

New damning testimony by one of actor Jussie Smollett’s alleged attackers portrays a methodical and deliberate scheme orchestrated by Smollett to portray the actor as a helpless victim of a hate crime.

39-year-old Smollett was an actor in the TV show “Empire” which was filmed in Chicago. According to Dan Webb, special prosecutor, Smollett was seeking attention after he received a lukewarm response from his studio regarding a hate letter he received.

Webb said that Smollett decided to hire brothers Abimbola and Ola Osundairo to stage a fake hate crime against him, saying “I want you to fake beat me up," according to local news.

In critical testimony, 28-year-old Abimbola testified in court on Wednesday and explained how he was approached by Smollett to stage a fake racist, homophobic attack against the actor, with instructions on what supplies to use all the way to what to write in a condolence message.

According to the Associated Press, Abimbola told jurors Smollett instructed him to punch the actor, but “not too hard.” Once Smollett was on the ground, Abimbola said Smollett told him to give the actor “a bruise” and “give him a noogie,” or rub his knuckles against Smollett’s head.

Abimbola also detailed a dress rehearsal that was planned by Smollett before the alleged staged attack, with the actor driving the brothers to the location where it would take place. They decided to use bleach rather than gasoline and Smollett said he wanted a city security camera to capture the attack for media purposes.

Per Smollett’s instructions, Abimbola said he and his brother Ola met the actor around 2 a.m. on Jan. 29, 2019 in Chicago. Abimbola shouted a homophobic slur while Ola said, “this is MAGA country,” a reference to former President Donald Trump’s campaign slogan, make American great again.

After that the brothers put a noose around Smollett’s neck and threw bleach on him, then ran away from the scene, according to Osundairo.

The next morning, Smollett’s attack grabbed national headlines and, per the actor’s instructions, Abimbola told jurors he texted Smollett saying, “Bruh, say it ain’t true. I’m praying for speedy recovery.”

According to Abimbola, he was given a $3,500 check from Smollett and that the money was for helping stage the attack and for a nutrition and workout program.

As to why he said yes to working with Smollett, Abimbola told jurors that at the time he worked as a stand-in on the show “Empire” and felt indebted to Smollett for helping with his acting career.

Smollett’s defense team has argued that the alleged attack did in fact take place and left Smollett bruised and battered. According to local news, Smollett’s attorney Nenye Unche called the Osundairo brothers, "sophisticated, highly intelligent criminals," and said their apartment had, "weapons of war," including multiple guns, ammunition, and heroin.

The brothers have also filed a defamation suit against two of Smollett’s attorneys in 2019, shortly after news of the hate crime allegedly being staged surfaced. The suit alleges that Smollett’s attorneys made false and harmful allegations about the brothers to the public in order to distract from Smollett’s own guilt. They also claim the comments have impacted both brothers’ careers, having lost talent agent contracts and career opportunities.

Smollett has pleaded not guilty to six counts of disorderly conduct, a class 4 felony that carries a sentence of up to three years in prison.

Testifying in his own defense, former Empire actor Jussie Smollett, 39, took the stand today at the Leighton Criminal Court Building in Chicago. He’s accused of lying to police and is charged with six felony counts of disorderly conduct. He has pleaded not guilty to all counts and denies hiring brothers, Abimbola and Olabingo Osundairo, to fake attack him on the early morning of January 29, 2019. If he’s found guilty, he faces up to three years in prison.

Both brothers testified for the prosecution last week that Smollett paid them $3,500 with very specific instructions about how he wanted to stage the hate crime. The prosecution also introduced evidence that it says shows ongoing communications about the attack, as well as a video of the dry run the day before it allegedly happened. On the stand today, Smollett denied that he hired anyone to attack him, and spent much of his time talking about growing up in a close-knit family with six children and performing as a child actor. He also talked about coming out and getting involved in charitable organizations to fight AIDS in the Black community. His role on Empire was a major career step, he told the court, portraying a Black gay man and making $100,000 per episode by season five of the hit show.

Smollett also admitted knowing both Osundairo brothers, having met Abimbola at a nightclub in 2017, and learning he also worked on the show. He said that a sexual relationship developed between them while visiting a gay bathhouse together, Steamworks in Chicago’s Boystown, and that they regularly used drugs while participating in sex acts.

“We were in a club,” Smollett said, “you go to the bathroom, go to a stall, do a bump, do a bump and then just kind of keep going in and then we went to the bathhouse … We did more drugs and made out.” The second time they visited Steamworks, he said they masturbated together. Smollett said he was embarrassed by his behavior, the New York Post reported, because his mother was listening to the testimony.

Smollett also admitted under oath that “Bon,” as he called him, would help him buy drugs, including cocaine, marijuana, and ecstasy.
“Ola,” on the other hand, “kind of creeped me out,” Smollett told the court. “Every time we were around him he didn’t speak to me … He wasn’t feeling me, it’s fine.” Osundairo testified last week that he did not have a sexual relationship with the actor, though he did visit Steamworks and procure drugs for him, he said.

While prosecutors say that Smollett identified two white men as being the perpetrators of the attack, in the opening statements, Smollett’s attorney, Nenye Uche, said they would prove that the brothers attacked Smollett, not for money but because they wanted to be his security, something that Smollett wouldn’t agree to. The defense also alleges the brothers asked Smollett for $1 million each to not testify in the trial. The prosecution presented evidence last week in the form of video, text messages, and ride shares, alleging that the brothers were hired by the actor because he was unhappy with how a hate-mail letter was handled on the set of Empire.
