1. There is in Dallas County, Texas, a suspected. place and
premises described and located. as follows: Residential apartment located at 1210 South Lamar Street, apartment number 1478, Dallas, Dallas County, Texas 75215. This residence is located inside an apartment complex named ?Southside Flats?. The apartment is on the fourth floor, with the front doorway situated in an interior hallway. Apartment door number 1478 is illuminated in metal with several additional lights in a vertical line to the left if facing the front door. The front door and door frame are olive in color.

2. There is at said suspected place and premises the following
item(s) constituting evidence of a criminal offense: Fired Cartridge
Casings, fired projectiles, firearms, ballistic vest, keys, trace
evidence such. as blood, video surveillance system, any contraband,
such as narcotics, and other items that may have been used in criminal offenses are located in the above described residence.

4. It. is the belief' of .Affiant, and she hereby charges and
accuses that: Within the residence located at 1210 South Lamar
Street, apartment number 1478 in Dallas, Dallas County, Texas 75215
are fired cartridge casings, fired projectiles, firearms, ballistic
vest, keys, trace evidence such as blood, video surveillance system, any contraband, such as narcotics, and other items that may have been used in criminal offense are located in the above described residence.
These items may' be of evidentiary 'value in. the Officer Involved Shooting that occurred on September 6, 2018 at about 10:00 pm at 1210 South Lamar Street, apartment 1478, Dallas, Dallas County, Texas. This incident being documented CH1 Dallas Police Department case number 198543?2018. During this incident, an off?duty Dallas Police Officer, who was wearing a full Dallas Police uniform, was attempting to enter apartment number 1478, with a set of keys. An unknown male, inside the apartment, confronted the officer at the door. A neighbor stated he heard an exchange of words, immediately followed by at least two gunshots. The officer possibly believed the subject was an intruder, drew her service weapon and fired at the subject, striking him in the chest. The subject, who is identified as Botham Shem Jean, was transported to Baylor Hospital where he was pronounced deceased.
Detective Angela Arredondo contacted. Botham Jean's sister, Allisa Findley, and she confirmed that Subject Jean is the sole occupant of the apartment residence located at 1210 South Lamar Street, apartment number 1478. An-Accurint Report for Law Enforcement lists Subject Jean's home address as 1210 South Lamar Street, apartment number 1478 in Dallas, Dallas County, Texas. The Affiant, Detective Angela
Arredondo, #7651, has reason to believe that fired cartridge casings,
fired projectiles, firearms, ballistic vest, keys, trace evidence such as blood, video surveillance system, any contraband, such as
narcotics, and other items that may have been used in criminal
offenses are in the above described residence. The crime scene has been secured and maintained as such by Dallas Police Officers.

5. Affiant has probable cause for said belief by reason. of the
following facts: 1, Angela E. Arredondo, the Affiant, have been
employed as a Police Officer with the Dallas Police Department for 20
years and I am currently assigned to the Special Investigations Unit.
On September~ 6, 2018, I, Affiant, personally assisted the investigation of the Officer Involved Shooting of Botham Shem Jean. Detective .Angela Arredondo contacted. Botham Jean's sister, Allisa Findley, and she confirmed that Subject Jean is the sole occupant of the apartment residence located at 1210 South Lamar Street, apartment number 1478. If you live in Dallas and want to Ask him... How in the fuck did he find probably cause for this? There isn't an explanation how these items became known. The officer's would have been able to enter the apartment... because of the shooting and if the items were in Plain view.. they wouldn't NEED A FUCKING SEARCH WARRANT!! You have the Plain view exception... So how the fuck did they find all of this shit.

Officer's add drugs in a search warrant... as grounds for the search... If they have probable cause to believe that there are drugs in the premises. This search warrant was based on specific items... which would have only been known if they were in plan view, if the officer searched the house before getting the warrant... or maybe in this scenario the items were brought into the place by Guyger. But if they were alleged to be her items... they would have mentioned it in the search warrant.. The Search Warrant was worded to make it seem like they were his items and deliberately leaked to the public in an attempt to give potential Grand Jury members for-knowledge... to make the Young Brother out as an Angry Black Dude. They could have used a consensual search...

DALLAS – Eight days after Botham Jean was shot to death in his own apartment by a Dallas police officer, lawyers for his family have called for the firing of the officer who shot him and blasted a search warrant that uncovered a small amount of marijuana in Jean’s apartment.

Officer Amber Guyger, who turned herself in to the Kaufman County Jail Sunday, remains on administrative leave.

“Dallas police needs to send the message that there’s no place for a woman like that,” Jean family attorney Lee Merritt said in a Friday press conference.

It has been the standard practice of the department to await indictment by a grand jury before firing police officers, although there have been situations in the past where an officer was fired prior to the grand jury’s decision.

Merritt referenced “two suspicious shootings” in Guyger’s tenure as an officer. In May of 2017, Guyger fired her weapon at a drug offender who engaged in a physical altercation with police and took an officer’s Taser. Guyger was no-billed in that case, meaning she was cleared of all charges.

Merritt and other Jean family lawyers have also criticized the search warrant that revealed about 10 grams – less than a half-ounce – of marijuana in Jean’s apartment. They claimed the release of that information was a “smear campaign” orchestrated by police to assassinate Jean’s character.

“It had a specific purpose in mind,” Merritt said. “On the night that he was killed, the Dallas police investigators were interested in finding information that could help assassinate his character.”

The attorneys have questioned why police would have including searching for “narcotics” in the affidavit seeking to search the Jean’s apartment.

Legal experts say there are valid reasons investigators would have done so.

“When you’re conducting an investigation, the whole point is you’re trying to figure out what happened. You don’t know what’s important,” said Chris Mulder, a Dallas attorney. “You get the warrant out of an abundance of caution and you list in the warrant anything that could possibly be relevant … so that nobody can complain about it later. It’s just good police work.”

Mulder and other legal experts say investigators would not want to risk evidence being thrown out because they did not include it in the search warrant. Legal experts pointed out that if police had not included narcotics in the search warrant and drugs had been found, for instance, in Guyger’s belongings left in Jean’s apartment, then that evidence would have been inadmissible in court.

“You go ahead and put it in there just in case you find it,” Mulder said.

He also says they may have included “narcotics” in the search warrant because someone may have already seen it out in the open in the apartment.

“I’m sure everybody saw it when they went in there to treat the man who had been shot,” Mulder said. “It’s in plain view. They’ve got to collect it."

The attorney and Jean’s family also were upset that the news that marijuana was found became public on the same day that his funeral was being held.

“The fact that, moments after this funeral, we’re now addressing questions like this tells you the issues that we have with police officers,” attorney Daryl Washington said. “And quite frankly, the fact that they released this information shows that police officers are known for covering for each other.”

However, the timing could have been coincidental. Thursday marked the deadline for the search warrant return – the list of items taken from the apartment – to be taken back to court. WFAA obtained its copy of the return from the court.

Among the items taken in the search were two bullet casings, a police backpack, Guyger’s ballistic vest and two used packages of medical aid.

A search of a crime scene is standard procedure. In cases where a person cannot voluntarily give consent for a search, investigators routinely obtain search warrants. Otherwise, investigators would risk that the evidence that was obtained would later be thrown out by a judge.

A consensual search was conducted on Guyger’s apartment in the hours after the shooting, according to information WFAA obtained from a source close to the investigation that was later confirmed by Merritt.

It is unclear if police took anything during that search. The source said he was unsure if anything was taken because investigators did not provide an inventory.

Still, Jean’s mother condemned the release of the information about drugs in her son’s apartment.

“If information like that comes out on my son then I will not sit back,” Allison Jean said. “It is time to recognize lives matter. My son’s life mattered.”

Lawyers on Friday also accused Dallas police of “preferential treatment” toward Guyger and alleged officers were leaking information to the media.

Search warrants, it should be noted, are court documents and thus are public record. Consensual searches are not public record because they aren’t accompanied by any corresponding court documents.

According to an arrest warrant affidavit, which was written by Texas Rangers investigators, Guyger mistakenly went to Jean's apartment after parking on the wrong floor. She found Jean's apartment door "slightly ajar," the affidavit said, and inserted a key into the door, fully opening it. Guyger then saw a "large silhouette" across the room and thought it was a burglar, the arrest warrant affidavit said.

She drew her firearm and yelled commands at Jean, according to the affidavit. Jean "ignored" the commands, so Guyger fired her gun twice, striking Jean, the affidavit said.

Jean was taken to Baylor University Medical Center, where he died.
