Did you really just break that down with levels? I was looking for a simple yes or no to the question.

The daughter inviting him AND telling him to take the truck, although neither belonged to her....would definitely make a difference to a jury and should make a difference to a DA. I think that's the point. The kid didn't break in but was invited by a resident.

The kid was already inside the vehicle before the shots were fired after he bolted for his life. The kid pulled off just before the shots were fired. Nobody with a once of common sense is going to think "Oh gee golly, he's firing a gun, let me hit the brakes on this fleeing vehicle that's saving my life and do a u-turn to return the vehicle to the violent terrorist that's currently firing shots at me" (WTF?) Only takes a couple secs to pull off in the truck versus trying to running down the road versus getting shot in the back. The violent rabid racist dad wasn't firing warning shots. Legally, it's a solid defense.

Are you more concerned about the vehicle or the kid's life?

What the dad was beyond "anger levels". It was attempted murder.

I don't know if you've got some info on this case that I don't but I'm going by what the op wrote, he said after the father woke up and knew the kid was there he went to get his gun, the daughter then gave the kid the keys to the truck and told him to run. If this is the case a stolen truck charge will stick because he didn't need the truck to put distance between him and the father, however, if he was already in the truck when the father approached as you suggest, then you're right, that's a good defense for taking the truck.

I think I was responding to someone who said the kid didn't sneak in because he was invited by the daughter. I have already acknowledged that even though the daughter is not the homeowner that the kid can't be charged with breaking and entering because she did let him in but as far as the truck, the kid knew that wasn't the daughter's truck to let him use. Unless the truck was absolutely the only way to put distance between the kid and the father then he stole the truck.

Yea, I read it as, according to the victim's mother, the kid was already in the truck just before the Yosemite Dad was handed the gun. Now, I'm only saying that based on her facebook post (which is 2nd hand info but I doubt she's lying). The more precise details will come out soon. Also, based on "I wanna kill him" screen shots from the Dad's facebook prior to this incident, he wanted to kill the kid regardless.
