Top Georgia Republicans dismiss pro-Trump calls to change pardon rules


Georgia’s most powerful Republican politicians rejected pro-Donald Trump calls to change the state constitution to give the governor direct authority to pardon those convicted of crimes.

Far-right Trump supporters have pressed Gov. Brian Kemp and other GOP leaders to pursue an overhaul of pardon rules after the former president was charged this week with orchestrating a far-ranging “criminal enterprise” to overturn his defeat in Georgia’s 2020 election.
Such a move would involve a constitutional amendment, which requires a two-thirds vote in the General Assembly and support from a majority of voters in a referendum. It can’t pass without significant Democratic support, rendering it a political impossibility.

Kemp adviser Cody Hall compared the conspiracy theories that dominated pro-Trump circles in the last presidential election to the pressure campaign now to overhaul the pardon process.

“Where have I heard special session, changing decades-old law, and overturning constitutional precedent before?” Hall asked. “Oh right, prior to Republicans losing two Senate runoffs in January of 2021.”

He added: “What are people hoping to learn in the second kick of the election-losing mule?”

A top deputy to House Speaker Jon Burns also dismissed the idea.

“Given the political makeup of the General Assembly,” Burns spokesman Kaleb McMichen said, “such an amendment is not feasible and thus would not merit consideration.”

‘Official forgiveness’

The pushback is a response to demands from Trump loyalists for a sweeping rewrite of the pardon regulations that have proliferated on social media and conservative outlets.

Among them is Mike Davis, a former GOP Senate aide who runs a conservative advocacy group. In a Fox News appearance this week, he called on Republican lawmakers to “give Gov. Kemp the ability to pardon in this situation because this is clear election interference.”

Trump’s allies could also attempt to overhaul the board’s regulations to speed up the timeline to consider a pardon — or allow members to issue a pardon at any time.

Even if Republicans had the votes to pass the measure, it’s unlikely Kemp would embrace a change.

The second-term Republican is no ally of Trump, who tried to oust him from office last year. And, like his recent predecessors, Kemp has made no attempt to exert direct control over the pardon process.

The law dates to 1943, when Georgia voters adopted a constitutional amendment after former Gov. E.D. Rivers was indicted on a slate of corruption charges that included accusations that he sold pardons.

It created a state Board of Pardons and Paroles whose five-member panel is appointed by the governor. The law limits who can seek a reprieve, permitting only those who have completed their sentence and “lived a law-abiding life” for at least five years to apply for a pardon.

Even those who are granted pardons by the Georgia board aren’t exonerated of wrongdoing.

“It does not expunge, remove or erase the crime from your record,” read a statement from the board, which compared a state pardon to an “order of official forgiveness” that can help a recipient line up a job or educational opportunity.

Trump’s bond in Georgia election interference case set at $200,000

The bond agreement came after Trump's lawyers met with officials from District Attorney Fani Willis' office. inside the Fulton County courthouse.

Former President Donald Trump has agreed to a $200,000 bond in the Georgia criminal case charging him with trying to illegally overturn the 2020 presidential election results in the state.

Under the terms of the "consent bond order" filed in court Monday afternoon, Trump agreed to the bond amount on charges that include racketeering, criminal conspiracy, criminal solicitation, filing false documents and making false statements.


The order was signed off on by Superior Court Judge Scott McAfee. The order, which was signed by Fulton County District Attorney Fani Willis and Trump's attorneys, says that Trump "shall perform no act to intimidate any person known to him or her to be a codefendant or witness in this case or to otherwise obstruct the administration of justice."

It also says the "Defendant shall make no direct or indirect threat of any nature against the community or to any property in the community; The above shall include, but are not limited to, posts on social media or reposts of posts made by another individual on social media."

The filing was filed with the court after members of Trump’s legal team — Drew Findling, Marissa Goldberg and Jennifer Little — were spotted entering the Fulton County Courthouse around 2:10 p.m. ET, walking in the direction of the DA’s office. They declined to comment to reporters on their way in.

Willis last week hit the former president and 18 others with racketeering charges for allegedly scheming to overturn the results of the 2020 election in the case, and gave the defendants until Aug. 25th to surrender voluntarily at the Rice Street Jail.

A date for Trump's surrender has not yet been announced, but three senior law enforcement officials have told NBC News that they expect it to happen late this week. In a news release Monday, the Fulton County sheriff's office said that when he does turn himself in "there will be a hard lockdown of the area surrounding the Rice Street Jail."

Other defendants agreed to bond packages with prosecutors Monday as well. As of late Monday afternoon, Trump's was the only one signed off on by Willis — the others were signed by her deputy. His was also the only one with terms that included not making threats to the community or on social media.

John Eastman, the lawyer charged with helping to orchestrate Trump's fake elector scheme, agreed to a $100,000 bond in the case on the charges including racketeering, criminal conspiracy and filing false documents.
McAfee signed off on the agreement Monday morning, the filing shows.

Under the terms of his order, Eastman "shall report to pre-trial supervision every 30 days," and "shall perform no act to intimidate any person known to him or her to be a codefendant or witness in this case or to otherwise obstruct the administration of justice."

The order also holds that Eastman "shall not communicate in any way, directly or indirectly, about the facts of this case with any person known to him to be a codefendant" or witness "in this case except through his or her counsel" — conditions Trump also agreed to.


Eastman — who's referenced but not charged as a co-conspirator in special counsel Jack Smith's federal criminal case against Trump for allegedly trying to subvert the 2020 election results — features prominently and repeatedly in the DA's indictment.

It alleges that Eastman helped come up with and carry out a scheme to have "alternate" presidential electors cast their votes for Trump in Georgia and several other states that were won by Joe Biden.

Eastman lawyer Harvey Silverglate said in a statement last week that the charges against his client and the 18 other defendants in the case "set out activity that is political, but not criminal" and that Eastman should not have been charged.

Another architect of the electors scheme named as a defendant in the case, lawyer Kenneth Chesebro, struck a similar deal, agreeing to a $100,000 bond.

Ray Smith, another Trump lawyer who was allegedly involved in the electors scheme, agreed to a $50,000 bond order, court filings show.

McAfee also signed off on a bond agreement involving another defendant in the case, Scott Hall. Hall is charged with racketeering and six criminal conspiracy counts relating to a scheme to access voting machines and data in rural Coffee County.

His bond was set at $10,000, the court filing shows.

Hall surrendered today, no word if he managed to pay his bond.

That leaves 16 mofos left who have to surrender to Fulton County.

The deadline is August 25 at 11:59pm. They don’t turn themselves in, a warrant for their arrest will be issued.

Majority of these fools are broke and have no money to pay their $100k bond.

And Trump ain’t paying for them.

Several Republican lawmakers are seeking ways to sanction Fulton County District Attorney Fani Willis after she brought criminal charges against former President Donald Trump and 18 allies.

Trump backers are going after Willis using a new state law approved by Gov. Brian Kemp that creates a state commission with power to sanction or oust prosecutors found to be neglecting their duties or responsible for an array of other violations.

State Sen. Clint Dixon said Monday that he would file a complaint against Willis in October when the Prosecuting Attorneys Qualifications Commission begins its proceedings, saying the indictments were sparked by Willis’ “unabashed goal to become some sort of leftist celebrity.”

“Once the Prosecutorial Oversight Committee is appointed in October, we can have them investigate and take action against Fani Willis and her efforts that weaponize the justice system against political opponents,” the Buford Republican said in a social media post.

“This is our best measure,” Dixon added, “and I will be ready to call for that investigation.”

This scenario is what a coalition of opponents, including Willis and Democratic leaders, warned about during debate over the legislation. It passed this year, mostly along party lines, at the urging of Kemp and Republican Lt. Gov. Burt Jones, a Trump supporter whose candidacy last year was backed by the former president.

Kemp and Republican sponsors said it was designed to pursue “rogue prosecutors” who were ignoring their duties or flouting the law, avoiding overt mention of Willis. Even so, Democrats warned it would inevitably be used to target her for investigating Trump.
Among them was state Rep. Dar’shun Kendrick, who cautioned during debate that Republicans could try to use the new law as a “prosecutorial overthrow” bill against Willis. She said Monday that she wasn’t surprised by Dixon’s move.

“The irony, as I see it, is that DA Willis has to do her very best to prosecute those involved in the interference case on Georgia,” Kendrick said. “Otherwise, she may be subject to removal by this commission.”

‘Rogue’ DAs or independent prosecutors?

It’s one of several GOP initiatives that seek to reprimand Willis, who brought charges accusing Trump and his allies of creating a “criminal enterprise” to subvert the 2020 election after an investigation that spanned more than two years.

State Sen. Colton Moore last week issued a call for a special legislative session to probe Willis. The effort is doomed to fail because it needs significant Democratic support, but it gained attention in conservative media outlets.

State Republican leaders said they would block pro-Trump efforts to change the state’s pardon laws to make it easier to exonerate the former president if he’s convicted.

And several GOP legislators are drafting a statement condemning Willis for deploying her office’s investigators in a case against Trump, who has said he’s the victim of a “witch hunt” and peddled derogatory baseless stories about the district attorney.

“Let’s not let off the hook criminals committing serious crimes to pursue political prosecutions to fuel future ambitions,” said GOP state Sen. Jason Anavitarte, who encouraged supporters to file complaints challenging the “egregious” resources Willis deployed to bring charges against Trump.
Willis, who declined to comment through a spokesman, described the bill creating the commission as racist at a state Senate hearing earlier this year. She said it was a GOP response to the 2020 election, when the number of minority district attorneys in the state grew from five to 14.

Georgia already allows legislators to impeach district attorneys, though those powers have rarely been invoked. There are other checks on wayward prosecutors encoded in the law, plus elections and recall provisions that give voters a chance to remove them at the ballot box.

But the commission’s sponsors say existing rules guiding prosecutors don’t have sharp enough teeth, a contention made by nearly two dozen district attorneys from mostly rural parts of Georgia who signed a letter backing the law.

Republican lawmakers often referred to former Paulding County District Attorney Dick Donovan, a Republican who temporarily remained in office while fighting bribery charges, or Athens-Clarke County District Attorney Deborah Gonzalez, a Democrat whom Kemp and his allies routinely paint as inept.

Under the new law, the commission will start receiving complaints in October, though it could take months before it starts to mete out punishments. A five-member panel will investigate the complaints and decide whether to bring formal charges, and a separate three-member panel will issue orders and opinions.

DeKalb County District Attorney Sherry Boston is among a bipartisan group of prosecutors who this month brought a lawsuit challenging the new law, which she said amounts to a power grab that threatens the independence of the judiciary.

She predicted last week that a Trump ally would use the law against Willis to “drag her into a commission to force her to answer questions about a prosecution that she is moving forward with because a crime was potentially committed in her jurisdiction.”

Boston, a Democrat, said she expected more complaints targeting prosecutors for political reasons.

“We can’t do our jobs fairly and impartially,” she said, “if we don’t have discretion or independence.”

Rudy Giuliani planning to meet with Fani Willis

Former Donald Trump lawyer Rudy Giuliani plans to meet with Fulton County prosecutors on Wednesday, according to CNN.
Giuliani will travel with longtime ally Bernard Kerik to meet with District Attorney Fani Willis, the report said. It is not clear whether the former New York City mayor has secured a Georgia-based attorney.

“It does appear that at this point, they have been able to find an attorney with a Georgia license who was at least willing and expected to help them tomorrow with the bond part of this procedure, and it's unclear though if this individual will be representing Giuliani throughout this case,” CNN legal analyst
“I'm also told that Giuliani would like to negotiate his bond and then do his surrender before the former President Trump shows up here in Georgia on Thursday.”

Entrepreneurial oddsmakers are offering online prop bets ahead of Trump’s surrender on charges he orchestrated a sweeping “criminal enterprise” to overturn the former his 2020 defeat in Georgia. Some of his codefendants have begun turning themselves in.


Trump said in a social media post that he will come to Atlanta on Thursday, the eve of the deadline announced by by District Attorney Fani Willis.

Trump was granted a $200,000 bond on Monday. Terms of the consent bond order say he Trump can’t engage in witness intimidation or communicate directly or indirectly about the facts of the case with any codefendants except through his lawyer. After spouting baseless claims about Willis’ personal life, Trump recently wrote on his social media site that the DA has “allowed Atlanta (Fulton County) to become a record setting Murder and Violent Crime War Zone.” Actually, violent crime is down more than 20% compared to this time last year, according to Atlanta Police Department data.

The site BetOnline is dealing only in facts. As the world waits for what could be the first-ever presidential mug shot, the betting site is letting gamblers lay odds on all sorts of stats, including Trump’s weight at booking. The site Bovada is taking bets on whether the former president will be handcuffed and what sorts of phrases he’ll post on Truth Social after his arraignment. “Marxist Left,” “Perfect Phone Call” and “Fake Indictment” are among the choices.

The Fulton County indictment marked the fourth time Trump has been indicted in recent months. He also faces criminal charges in New York along with two federal probes — one in Florida and the other in Washington D.C.
