Six of 19 defendants in Georgia Trump election conspiracy case surrender

As of Wednesday morning the following defendants have surrendered:

• Scott Hall, a Georgia bail bondsman, faces seven counts. His bond was $10,000.

• John Eastman, a conservative lawyer, is charged with nine counts and was freed on a $100,000 bond.

• Cathy Latham, a Republican official, faces 11 counts. Her bond was $75,000.

• David Shafer, the former chairman of the Georgia GOP, is charged with eight counts. His bond was $75,000.

• Kenneth Chesebro, a conservative lawyer, was charged with seven counts. His bond was set for $100,000.

• Ray Smith III, a lawyer for Trump's re-election campaign, faces 12 charges. His bond was $50,000.

Judge denies Jeffrey Clark’s attempt to block arrest in Georgia


A federal judge Wednesday rejected former Trump Justice Department official Jeffrey Clark’s bid to block his arrest in the Fulton County, Ga., election case.

Clark sought to block his arrest ahead of Fulton County District Attorney Fani Willis’s (D) Friday deadline for defendants to surrender.

Clark had argued his arrest and the state proceedings should be halted while he attempts to move the case to federal court.

But U.S. District Judge Steve Jones denied the effort in a six-page ruling late Wednesday afternoon, only hours after Willis opposed Clark’s demand. A ruling on his attempt to move his case to federal court has not yet been made.

Jim Jordan launches probe into Georgia Trump prosecution

House Judiciary Chairman Jim Jordan (R-Ohio) fired off a sweeping request for documents dealing with former President Trump’s prosecution for election interference in Georgia, asking Fulton County District Attorney Fani Willis (D) to turn over all records relating to the case.

Sent hours before Trump is expected to surrender at the Fulton County Jail, the letter cites “concerns about [Willis’s] motivation” in bringing the case and suggests her sprawling racketeering indictment against the former president and 18 others highlights “the threat that such state prosecutions can pose to the operations of the federal government.”

The letter also asked whether Willis at any point communicated with the team of special counsel Jack Smith, who earlier this month brought federal charges against Trump related to his efforts to overturn the results of the 2020 election.
The letter mirrors those the committee has sent related to other criminal cases against Trump and echoes the former president’s frequent complaints that all of the charges leveled against him are motivated by politics rather than any wrongdoing.

“The timing of this prosecution reinforces concerns about your motivation,” Jordan wrote.

“You did not bring charges until two-and-a-half years later, at a time when the campaign for the Republican presidential nomination is in full swing,” he continued. “Moreover, you have requested that the trial in this matter begin on March 4, 2024, the day before Super Tuesday and eight days before the Georgia presidential primary.”
Willis’s office did not immediately respond to a request for comment.

Jordan’s panel has frequently sought information on criminal probes into Trump at key junctures.

He sent a letter to Manhattan District Attorney Alvin Bragg (D) before he had even brought charges against Trump, writing that he was “reportedly about to engage in an unprecedented abuse of prosecutorial authority.”

He’s also sent two letters to Attorney General Merrick Garland concerning Smith’s investigation.

Thursday’s letter lays out a case for Trump, arguing the actions he took in Georgia — asking the secretary of state to “find” enough votes for him to win and assembling a slate of fake electors — could be considered official actions taken by a president.

“When states rely on acts like these—apparently taken in connection with official duties—to criminally prosecute federal officers, it raises serious concerns under the Supremacy Clause of the Constitution and poses a threat to the operations of the federal government,” Jordan writes.

“The threat of future state prosecution for official acts may dissuade federal officers from effectively performing their official duties and responsibilities.”

He also posits that such prosecutions could have a chilling effect on presidents while in office.

“To the extent that presidents fear that they may be subject to politically motivated prosecutions after they leave office, this could impact the policies they choose to pursue while in office,” Jordan said.

“And because this former President is a current candidate for that office, the indictment implicates another core federal interest: a presidential election.”

For her part, Willis has denied having any contact with Smith.

“I don’t know what Jack Smith is doing, Jack Smith doesn’t know what I’m doing. In all honesty, if Jack Smith was standing next to me, I’m not sure I would know who he was. My guess is he probably can’t pronounce my name correctly,” Willis told local media ahead of filing charges.

Fulton County D.A. Fani Willis proposes new Oct. 23 trial date for Trump and 18 co-defendants

Fani Willis, the district attorney in Fulton County, Georgia, asked a judge on Thursday to set a trial date of Oct. 23, 2023, for former President Donald Trump and the 18 other defendants charged in connection with alleged efforts to overturn the state's 2020 election results.

Willis previously proposed that the trial should start on March 4, 2024. But in response to defendant Kenneth Chesebro's request for a speedy trial, Willis called for proceedings to begin for all defendants on Oct. 23 of this year instead.

The proposed timeline is aggressive and sure to elicit pushback from defendants given the complexity of the case and the mountains of evidence that defense teams are entitled to review before any trial begins. In each of the three other cases in which Trump faces charges, his attorneys have asked for trials to be delayed beyond the presidential election next November.

It's unclear when the judge in the Georgia case might decide on a trial schedule.

Chesebro, an attorney who supported Trump, filed a "demand for speedy trial" on Aug. 23.

"Without waiving any objection as to the sufficiency of defendant Kenneth John Chesebro's filing, the state requests that this court specifically set the trial in this case to commence on October 23, 2023," Willis wrote in response.

Scott Grubman, an attorney for Chesebro, said in a statement that his client "will be prepared to move forward with trial for whatever date the Court ultimately sets." In an earlier statement, Grubman said Chesebro "maintains his innocence and remains confident as the legal process continues."

Trump and 18 of his associates were indicted on racketeering, election fraud and other charges last week related to alleged attempts to overturn the state's 2020 election results.

The new proposed trial date comes as defendants in the case, including former New York Mayor Rudy Giuliani, continue to turn themselves in ahead of a noon Friday deadline to surrender. Trump is expected to arrive in Fulton County for processing on Thursday evening and has denied all wrongdoing. Giuliani has also maintained his innocence.

Meadows, Clark bail set at $100,000 in Georgia case


Former Trump administration officials Mark Meadows and Jeffrey Clark agreed to a $100,000 bail Thursday in the Georgia election case.

Prosecutors and defense attorneys have been negotiating pretrial release conditions in the lead up to a Friday deadline set by Fulton County District Attorney Fani Willis (D) for the co-defendants to surrender.

Meadows and Clark were some of the final co-defendants to have their bond agreement signed by the state judge overseeing the case. Also on Thursday, bail was set at $75,000 for Trevian Kutti, a former publicist for rapper Ye, previously known as Kanye West.

Only one defendant, Harrison Floyd, a leader of Black Voices for Trump who is accused of intimidating an election worker, has yet to reach an agreement. Floyd was notably arrested earlier this year for allegedly assaulting an FBI agent, court filings show. The arrest was first reported by The Washington Post.

Meadows and Clark each face two counts in the indictment.

They are first charged with racketeering, as are all of the other co-defendants.

Clark, a Justice Department official who Trump wanted to appoint as attorney general to investigate his baseless claims of election fraud, is also charged with a criminal attempt to commit false statements and writings. Clark allegedly desired to send a letter to Georgia authorities asking them to hold off on certifying their election results while the department investigated.

Meadows,who served as White House chief of staff in the final months of the Trump administration, also faces a count of soliciting a public officer to violate their oath over his participation in the infamous Jan. 2, 2021, call between Trump and Georgia Secretary of State Brad Raffensperger (R), wherein Trump urged Raffensperger to help him “find” enough votes to change the election result.

Meadows and Clark deny any wrongdoing. They are attempting to dismiss the charges by requesting to move the case to federal court and assert immunity. A hearing is scheduled for Monday on Meadows’s request, and Raffensperger and others on the call were subpoenaed to testify.

Meadows and Clark had separately attempted to block his arrest as he tries to move the charges, but a judge denied their bids late Wednesday afternoon.

Their $100,000 bail amounts are on the higher end for the co-defendants who have struck agreements so far. Trump’s bail was set at $200,000, the highest yet, and Rudy Giuliani’s bail was set at $150,000.

Meadows’s and Clark’s amount mirrors those given to Trump attorneys John Eastman, Sidney Powell, Jenna Ellis and Kenneth Chesebro.

Bail for the other co-defendants so far has clocked in at five figures.
