As I said earlier I certainly do not agree with how the police handled the matter, endorse the cop, nor the end result.

I can however, as a rational human, understand why if a police office is called in to address an emergency distress 'a man holding and pointing a gun at people' dispatch, that police officer would think their life is in jeopardy if upon arrival the suspect begins drawing a weapon from under the jacket (or performing the motion) whether given proper warning or not.

No one has to wait for an "armed" assailant to get a bead on them first if they can prove their was a reasonable expectation of loss of life or grievous bodily harm.

The Supreme Court has upheld this basic premise without predjuice.

Hindsight is 20/20. Perfect information isn't available to anyone until after events transpire.

This doesn't excuse anyone's actions or nullify the pain of the loss of a child.

But to proffer that the kid had a toy gun - as some are suggesting - as if he has a big neon orange Nerf pop dart and was just minding his business, and the cop woke up with a mindset to mow down a child, it is a reach on all accounts.

So Retlaw is back and name is Nibbs.

This is not as cut and dry as folks would like it to be. Yes, he's a kid in the park with a fake gun. But watching the video, you can't tell it's fake and you can't tell he's a kid. Plus he's pointing the shit at random people. That's gonna attract the wrong type of attention, whether it's police or just the average person on the street. If one of those passersby had been holding the kid woulda got capped.

Of course, the cop is an idiot. That's been well documented. This is just a perfect storm of a meeting between two less than intelligent individuals that ended badly.

Tamir Rice of Cleveland would be alive today had he been a white 12-year-old playing with a toy gun in just about any middle-class neighborhood in the country on the afternoon of Nov. 22, 2014.

But Tamir, who was shot to death by a white police officer that day, had the misfortune of being black in a poor area of Cleveland, where the police have historically behaved as an occupying force that shoots first and asks questions later. To grow up black and male in such a place is to live a highly circumscribed life, hemmed in by forces that deny your humanity and conspire to kill you.

Those forces hovered over the proceedings on Monday when a grand jury declined to indict Officer Timothy Loehmann in the killing and Timothy McGinty, the Cuyahoga County prosecutor, explained why he had asked the grand jurors to not bring charges. Mr. McGinty described the events leading up to Tamir’s death as tragic series of errors and “miscommunications” that began when a 911 caller said a male who was “probably a juvenile” was waving a “probably fake” gun at people in a park.

The fact that those caveats never reached Officer Loehmann — who shot the child within seconds of arriving on the scene — was more than just an administrative misstep. It reflects an utter disregard for the lives of the city’s black residents. That disregard pervades every aspect of this case and begins with the fact that the department failed to even review Officer Loehmann’s work history before giving him the power of life and death over the citizens of Cleveland. Had the department done so, it would have found that Officer Loehmann had quit a suburban police department where he had showed a “dangerous loss of composure” during firearms training and was found to be emotionally unfit for the stress of the job.

Officer Loehmann joined a police department that itself had acquired a well-documented reputation for wanton violence and for shooting at people who posed no threat to the police or others. In a particularly striking event, documented by the Justice Department last year, officers mistook the sound of a car backfiring for a gunshot. They chased down and fired at the vehicle 137 times, killing two occupants who turned out to be unarmed.

The lengthy Justice Department report shows clearly why the black community viewed the Cleveland police as dangerous and profoundly out of control. In May, the Police Department entered an agreement with the Justice Department, enforceable by the courts, under which it is to adopt sweeping reforms.

The Police Department’s disregard for life was fully evident in the way the officers behaved after shooting Tamir. A surveillance video shows them standing by the child for four minutes without giving medical assistance, which was finally provided by an F.B.I. agent who happened to be in the neighborhood. Officer Frank Garmback, Officer Loehmann’s partner, nonetheless tackled the wounded boy’s 14-year-old sister as she tried to rush to his side. One can only imagine her suffering as she watched in handcuffs from the back seat of the squad car while her brother lay bleeding on the ground.

In addition to portraying the killing as a result of a tragic misunderstanding, prosecutors have also suggested the officer’s decision to kill Tamir was shaped by the fact that the surrounding neighborhood had a history of violence and that the boy appeared to be older than 12 because he was big for his age.

These arguments sidestep the history of violent, discriminatory police actions that led up to this boy’s death. They also have the reprehensible effect of shifting the responsibility for this death onto the shoulders of this very young victim.

After seeing no indictment in the Mike Brown case. I started thinking back at the Trayvon Martin case, who remembers watching CNN after the verdict and Sunny Hoston said, "the prosecutors presented a weak case"? They never brought up race, they didn't bring up G. Zimmerman calling Trayvon a "coon". That's the other side of the KKK at work. They are bringing them to trial but purposely not prosecuting them to the fullest extent.

Mr. Hayes knows nothing of gun laws.
Open carry means holstered or slung, and often unloaded in certain jurisdictions.

It does not provide allowance for brandishing your weapon and absolutely not drawing and pointing your weapon at random passers by.

I was watching that Black Panthers documentary last night. The part that resonated the most even now, was when Bobby Seale was going through the 10 points of the Panthers. Demanding what the black community needed from this country, as a race, we are so far behind. It's mind boggling because, there are so many WEALTHY blacks who look down upon the poor blacks, as if they were never in that situation :smh:

Ignore the white boys in here saying that a KID shouldn't be playing with a TOY gun. They know that the toy had nothing to do with the kid being shot. I played with toy guns as a kid and my kids will too. Every fucking kid has played with toy guns whether they looked real or not. It is always more than one side to a fight and different people have different roles similar to individual players on a football or basketball team. The problem is that we get so emotional that we draw a line in the sand and lash out against anyone who has an alternative method of fixing the issue that differs from theirs. Better parenting plays a huge role in the young man being killed. That is something that we should not ignore. There are two problems and both need to be addressed

I understand where you are coming from, but how can I not point out how dumb it is for our folks to kill people on a reg for stupid shit like twitter post and diss records yet they are ok when cops kill our kids... If your going to live reckless, at least do it for a good reason... If you are only reckless towards your people then you are a super coon that is programmed to kill your own people and unlike the other coons who all they do is talk shit never doing anything, these coons are the worst because they actually are harming regular black folks...
Every act of violence is not racially motivated.

It's not about knowing if the gun is fake or not. It's the case of, "they wouldn't do that to a white kid." As with MOST of these black shootings.
Your basically saying that the facts don't matter, only the conclusion matters. I think everyone would be better served if we reverse engineered our current mode of analysis and look at the facts first, as ugly as they may be, and begin to draw conclusions based on those facts.

The internet seems to work in the opposite direction.

I've often wondered the same thing. If a fool is willing to do decades in jail behind slinging some dope why not drop a few crooked cops and make it worth your while.
Because that would make them a serial killer. Most criminals are not some emotionless person and only commit crimes for survival

Trayvon wore a hoodie and people made this same excuse. Being born black puts you in danger.

Ok, so around the 1:10 mark the kid is seen walking up to someone and showing them the weapon, later he points the toy gun in that direction.

Now some folk are characterizing Tamir's behavior before police engagement as just a kid in the park playing with a toy gun. After seeing the video I'm not convinced this characterization is accurate.

But most people have no need for this particular set of facts, so they ignore it and move on to better facts which supports their conclusion.

It's apparent that there are many cacs in this thread. Attempting to rationalize the actions of Tamir Rice being murdered is a manifestation of their innate iniquity.

Often, I say something to the effect of the iniquity of the cac.

They are evil; no further dialogue needs to be made.

especially when there is documented video proof of white folks actually shooting officers and being taken in without being killed or shot.

Except that the officer didn't drive up and shoot him.
He shot him because Tamir raised his jacket and reached in his waist band as the officer exited the cruiser, which to any rational person looks like a weapon drawing motion since most weapons, especially firearms, are kept at the waistband level.

How many times have people been told, when approached by police make no sudden movements and reach for nothing until commanded!

I know if I'm exiting my vehicle and I see someone make a motion like this as I am exiting, and after being given a description of this person holding a weapon and pointing it at people, I'm thinking they're going to draw down on me and possibly try to shoot me.

He drove up on the boy because he is a certified well-documented jackass. Had it been any other cop on the force that day the kid would probably be alive.
