Trump lawyers ordered to hand over names of individuals hired to search Trump properties for classified documents

A federal judge has asked former President Donald Trump's attorneys to turn over the names of the individuals hired to search four properties for documents late last year, a source familiar with the order told CNN.

The names were handed over Wednesday night, two sources told CNN.

It's the latest twist in the Justice Department's efforts to use the court to enforce a subpoena from May that sought to collect all classified records Trump kept in his possession after leaving the presidency. The New York Times first reported the development.


Trump's legal team hired two individuals to search Trump Tower in New York, the Bedminster golf club, an office location in Florida, and a storage unit in Florida where ultimately two documents with classified markings were found, CNN has previously reported. Those documents were handed over to the FBI. No other documents with classified markings were found during the search of the four Trump's properties.

The Justice Department had removed 11 sets of classified documents from Trump's Mar-a-Lago residence while executing a search warrant in August for possible violations of the Espionage Act and other crimes.

The four searches overseen by Trump's legal team came amid lingering concerns from the Justice Department that not all documents had been returned to the federal government.

At the time, Trump's attorneys had offered to let federal investigators observe the search at his Bedminster property, but that offer was declined. Given the Justice Department's response, Trump lawyers did not make a similar offer for the search of the other properties. It would be highly unusual for the Justice Department to observe searches that aren't conducted by law enforcement.

Special counsel Jack Smith, appointed by Attorney General Merrick Garland in November, is overseeing the criminal investigations into the retention of national defense information at Mar-a-Lago and parts of the January 6, 2021, insurrection. The situation related to the Mar-a-Lago documents and the Trump team's response to the May subpoena has become an important aspect of the probe, which includes prosecutors' accusations of obstruction of justice.

Last month, federal judge Beryl Howell, the chief of the DC District Court, declined to hold Trump in contempt of court and urged the Justice Department and Trump's team to work out a resolution as investigators attempt to make sure all national security records are back in the possession of the federal government. The judge had questioned prosecutors on how she could hold Trump's team in contempt given the steps Trump's lawyers had taken to alleviate the Justice Department's concerns that there may still be records in Trump's possession, according to sources.

The DOJ had sought to hold Trump and his office in contempt for not fully complying with a subpoena following the search of his Mar-a-Lago resort in August.

After the DOJ subpoenaed Trump for documents with classified markings in his possession in May, prosecutors went to court to enforce the grand jury subpoena. The judge ordered Trump's team to comply. That prompted the search by Trump lawyers that yielded the two additional documents with classification markings.

Also on Thursday, the Justice Department argued for continued secrecy around any grand jury proceedings following the May 2022 subpoena and August search, after media organizations sought access to more of what is happening in court behind closed doors.

The judge, Howell, hasn't decided if any new documents can be released.

"The Government has not publicly disclosed any request to hold the former President or his representatives in contempt. Nor can the Government confirm or deny whether it has made any such request," the DOJ argued in the filing. "To the extent any such request exists, it and any related proceedings would be in connection with secret grand jury proceedings protected from disclosure."

The DOJ, however, previously discussed the May subpoena and publicly said officials didn't believe Trump had fully complied.

OPEC’s Second-Largest Oil Producer Issues Arrest Warrant For Donald Trump

The Iraqi supreme court has issued an arrest warrant for former U.S. President Donald Trump for the assassination on Iraqi soil of Iran’s Quds Force commander, Qasem Soleimani, IraqiNews reports, citing a Baghdad news agency.

The warrant was issued on Thursday in connection both with the killing of Soleimani and of another Iraqi militia leader, chief of staff of the Popular Mobilization Forces (PMF) in Iraq–both of whom were killed in a drone strike in January 2020 near the Baghdad airport.

That assassination operation led to Iranian strikes on the Aia Al-Assad U.S. base in Iraq.


The arrest warrant charges Trump with premeditated murder. While the warrant is clearly symbolic, a conviction of this nature carries the death penalty.


The court said the investigation into the killings was still ongoing, AP reported.

Citing Baghdad Today news agency, IraqiNews quoted Supreme Judicial Council head Faiq Zaidban as calling on Baghdad to hold Trump “accountable for this heinous crime”.

At the same time, in November, Iraq’s parliamentary speaker confirmed that hundreds–and possibly thousands–of people had been kidnapped and killed by Iran-backed militias from 2014 to 2016.


Iraq, the second-largest oil producer in OPEC, is caught between rivals Iran and the United States, while Iran’s influence has grown exponentially since the toppling of Saddam Hussein following the 2003 U.S. invasion.

In October, ending a long-running stalemate, Iraq’s parliament named a new pro-Iranian prime minister and pro-Iranian parties now dominate, having sidelined Shi’ite rival Moqtada al Sadr, who had been paralyzing the government with anti-Iranian protests.

The PMF figure assassinated in a Trump-ordered military operation represented the head of an umbrella group that brought together pro-Iranian militias in Iraq, which enjoyed government support as a loosely defined element of the Iraqi armed forces.

U.S. attorney reviewing documents marked classified from Joe Biden's vice presidency found at Biden think tank

Attorney General Merrick Garland has assigned the U.S. attorney in Chicago to review documents marked classified that were found at the Penn Biden Center for Diplomacy and Global Engagement in Washington, two sources with knowledge of the inquiry told CBS News. The roughly 10 documents are from President Biden's vice-presidential office at the center, the sources said. CBS News has learned the FBI is also involved in the U.S. attorney's inquiry.

The material was identified by personal attorneys for Mr. Biden on Nov. 2, just before the midterm elections, Richard Sauber, special counsel to the president confirmed. The documents were discovered when Mr. Biden's personal attorneys "were packing files housed in a locked closet to prepare to vacate office space at the Penn Biden Center in Washington, D.C.," Sauber said in a statement to CBS News. The documents were contained in a folder that was in a box with other unclassified papers, the sources said. The sources revealed neither what the documents contain nor their level of classification. A source familiar told CBS News the documents did not contain nuclear secrets.

Sauber also said that on the same day the material was discovered, Nov. 2, the White House counsel's office notified the National Archives, which took possession of the materials the following morning.

"The discovery of these documents was made by the President's attorneys," Sauber said. "The documents were not the subject of any previous request or inquiry by the Archives. Since that discovery, the President's personal attorneys have cooperated with the Archives and the Department of Justice in a process to ensure that any Obama-Biden Administration records are appropriately in the possession of the Archives."

Garland assigned U.S. Attorney for the Northern District of Illinois John Lausch to find out how the material marked classified ended up at the Penn Biden Center. The review is considered a preliminary step, and the attorney general will determine whether further investigation is necessary, including potentially appointing a special counsel.

Lausch was nominated to be U.S. attorney by former President Donald Trump, and he is one of only two current Trump-era U.S. attorneys still serving. The other is Delaware U.S. Attorney David Weiss, who is leading an investigation into the president's son, Hunter Biden.

Lausch recently briefed the attorney general and will eventually submit a final report to Garland. The review is expected to conclude soon.

The Penn Biden Center is a think tank about a mile from the White House, in Washington, D.C., that is affiliated with the University of Pennsylvania and named for the sitting president.

The Presidential Records Act requires all presidential and vice-presidential documents be turned over to the National Archives. There are special protocols to keep classified information secure.

President Biden learned about the presence of the documents when his lawyer reported them to the White House counsel's office in November. A source familiar said the president is unaware of their contents. The documents are believed to be currently held in a secure location in Washington.

Lauch's review will examine, in part, how the documents got from Mr. Biden's vice-presidential office to the Penn Biden Center.

The Penn Biden Center and the University of Pennsylvania did not respond to a request for comment. The National Archives declined to comment. Attorneys assigned to oversee Biden's vice presidential records, Robert Lenhard, James Garland and Dana Remus, did not reply to voice messages and an email seeking comment. The Justice Department and FBI declined to comment.

A source familiar said the Office of the Director of National Intelligence (ODNI) is aware of the Justice Department inquiry. The ODNI also declined to comment.

GOP House Speaker Kevin McCarthy called the recovery of classified documents from Mr. Biden's time as vice president "very concerning." He added, "He's had these classified [documents], and what has he said about the other president with classified documents?" Asked if this instance is different because attorneys found them and "immediately" handed the material over, McCarthy replied, "Oh, really? They just now found them after all those years."

The Penn Biden Center case has parallels to the Justice Department's pursuit of Donald Trump's presidential records — but the scope and scale are materially different. In August, the FBI executed a search warrant at Mar-a-Lago that yielded hundreds of documents marked classified.

That unprecedented search followed more than a year of tussling between Trump's representatives, the National Archives, and the Justice Department. The search warrant was sought and executed in August after multiple failed attempts by the federal government to retrieve what it considered to be sensitive documents at the former president's personal residence that should have been turned over to Archives under law.

The trove at Mar-a-Lago contained, among other material, secrets about nuclear capabilities and correspondence between Trump and North Korean dictator Kim Jong-un. An initial batch of 15 boxes was returned in January 2022, but Archives officials believed some records were still unaccounted for, prompting the agency to refer the matter to the Justice Department in February 2022.

The initial discovery of classified documents in an office used by Biden after his vice presidency was first reported on Monday by CBS News.

The classification level, number and precise location of the additional documents was not immediately clear. It also was not immediately clear when the additional documents were discovered and if the search for any other classified materials Biden may have from the Obama administration is complete.

Biden aides have been sifting through documents stored at locations beyond his former Washington office to determine if there are any other classified documents that need to be turned over to the National Archives and reviewed by the Justice Department, the person familiar with the matter said.

The search was described as exhaustive, with the goal of getting a full accounting of all classified documents that may have inadvertently been packed in boxes when Biden cleared out of the vice president’s office space in January 2017.

Sen. Josh Hawley, R-Mo., reacted on social media minutes after the NBC News report on the new documents, tweeting out the words "Special counsel."

The White House on Monday issued a statement confirming that a “small number of documents” with classified markings that appeared to be from the Obama administration had been found at a Washington think tank tied to Biden on Nov. 2.

The documents were discovered in a locked closet by Biden’s attorneys while they prepared to vacate office space at the Penn Biden Center for Diplomacy and Global Engagement, Richard Sauber, special counsel to the president, said in a statement Monday.

The University of Pennsylvania had leased a suite of offices for the center in February 2018, including one for then-private citizen Biden’s personal use when he was in Washington.

Biden told reporters Tuesday that he was "surprised" by the discovery, and that he didn't know what was in the documents.

The chair and vice chair of the Senate intelligence committee have written to Director of National Intelligence Avril Haines asking for access to the classified documents, a damage assessment by the intelligence community and a briefing on both the Biden and Trump documents, three congressional staffers said. This request is similar to how the committee requested information after the raid at Mar-a-Lago, former President Donald Trump's resort in Florida, the staffers said.

Sauber said Biden's lawyers immediately reached out to National Archives about the find, and the agency took control of the documents the next day.

Two sources familiar with the matter said less than a dozen documents with classified markings were found at the office.

The Archives referred the matter to the Justice Department.

Trump has repeatedly mocked Biden over the find on his Truth Social account, while suggesting he'd been unfairly targeted by federal investigators, despite the very different fact sets between his and Biden's cases. "A giant Scam," he wrote.

Bradley Moss, a lawyer who specializes in national security issues and a frequent Trump critic, tweeted after the NBC report: "Nothing I have seen has changed my mind yet that Biden and his team, for now at least, are not at risk of criminal exposure. Nor do I have any reason to believe this changes the calculus on an indictment of Trump. That said, this sloppiness by Biden’s staff angers me."
