The latest news in the investigation of Donald Trump’s handling of classified documents

• A federal grand jury in Florida is meeting in special counsel Jack Smith's investigation of former President Donald Trump’s handling of classified documents, according to sources familiar with the investigation.

• Longtime Trump aide Taylor Budowich was asked yesterday before the grand jury about a past public statement on behalf of Trump representing that the former president had not retained classified records, a source said.

• The Florida grand jury is separate from a panel that was convened in Washington, D.C.

• The investigation began last year when the National Archives alerted the FBI that government documents Trump had returned after having been out of office for about a year included 184 that were marked classified. Trump has denied any wrongdoing.

Trump says DOJ has 'informed my attorneys that I have been Indicted'

In a post on Truth Social, Trump said his lawyers were informed he's been indicted.

"The corrupt Biden Administration has informed my attorneys that I have been Indicted, seemingly over the Boxes Hoax," Trump wrote on Truth Social.

"I have been summoned to appear at the Federal Courthouse in Miami on Tuesday, at 3 PM. I never thought it possible that such a thing could happen to a former President of the United States, who received far more votes than any sitting President in the History of our Country, and is currently leading, by far, all Candidates, both Democrat and Republican, in Polls of the 2024 Presidential Election. I AM A INNOCENT MAN!

He’s running to evade justice. I think the stress of his eventual loss will be his opportunity to be near his ex wife.

Trump is the first former president in U.S. history to face federal charges.

The Justice Department took the legally and politically momentous step of lodging federal criminal charges against former President Donald J. Trump, multiple people familiar with the matter said on Thursday. The charges follow a lengthy investigation of his handling of classified documents that he took with him upon leaving office and into whether he obstructed the government’s efforts to reclaim them.

The indictment, filed in Federal District Court in Miami, is the first time in American history a former president has faced federal charges. It puts the nation in an extraordinary position, given Mr. Trump’s status not only as a onetime chief executive but also as the front-runner for the 2024 Republican presidential nomination to face President Biden, whose administration will now be seeking to convict his potential rival.
Mr. Trump was charged with a total of seven counts, including willfully retaining national defense secrets in violation of the Espionage Act, making false statements and an obstruction of justice conspiracy, according to people familiar with the matter.
Mr. Trump is expected to surrender himself to authorities in Miami on Tuesday, according to a person close to him and his own post on Truth Social.
The indictment, filed by the office of the special counsel Jack Smith, came about two months after local prosecutors in New York filed more than 30 felony charges against Mr. Trump in a case connected to a hush money payment to a porn star in advance of the 2016 election.
Mr. Smith is also investigating Mr. Trump’s wide-ranging efforts to retain power after his election loss in 2020, and how those efforts led to the Jan. 6, 2021, assault on the Capitol by a pro-Trump mob.
Public filings in the documents case have painted a picture of Mr. Trump repeatedly stonewalling efforts by both the National Archives and Records Administration and the Justice Department to retrieve the trove of hundreds of sensitive government records that the former president took with him from the White House and kept mostly at his private club and residence in Florida, Mar-a-Lago.
While the nature of a few of the documents found in Mr. Trump’s possession is known — he had held onto letters from the North Korean dictator Kim Jong-un, for example — it remains unclear what other classified materials were found at Mar-a-Lago and what national security damage his possession of them caused, if any.
Mr. Trump has repeatedly characterized the investigation as a politically motivated witch hunt, and in recent weeks his lawyers have sought to raise what they say are issues of prosecutorial misconduct.
Here’s what to know:
  • The indictment reaches back to the end of Mr. Trump’s term in January 2021, when the documents — many of which were said to be in the White House residence — were packed in boxes along with clothes, gifts, photos and other material, and shipped by the General Services Administration to Mar–a-Lago.
  • After lengthy efforts by the National Archives throughout much of 2021 to get Mr. Trump to turn over the material he had taken with him — considered government property under the Presidential Records Act — Mr. Trump turned over 15 boxes of material in January 2022. The boxes turned out to contain highly sensitive material with classified markings, prompting a Justice Department investigation.
  • Last August, federal agents descended on Mar-a-Lago to conduct an extraordinary search that turned up material that Mr. Trump had failed to turn over in response to a subpoena months earlier demanding the return of any classified documents still in his possession.
  • The Justice Department has repeatedly questioned Mr. Trump’s level of cooperation with the efforts to recover the documents, saying that it had recovered more than 100 documents containing classified markings even after an attestation by one of Mr. Trump’s lawyers that a “diligent search” by his legal team had not turned up any further materials.
  • Mr. Trump still faces other open criminal investigations. They include Mr. Smith’s inquiry into Mr. Trump’s efforts to hold onto power following his election loss — and how they led to the Jan. 6, 2021, assault on the Capitol — and an investigation by a prosecutor in Georgia into his attempts to reverse his 2020 election loss in that vital swing state. Mr. Trump is scheduled to go on trial in Manhattan next March after he was charged in connection with a hush-money payment to a porn star.

Exclusive: Donald Trump admits on tape he didn’t declassify ‘secret information’

Former President Donald Trump acknowledged on tape in a 2021 meeting that he had retained “secret” military information that he had not declassified, according to a transcript of the audio recording obtained by CNN.

“As president, I could have declassified, but now I can’t,” Trump says, according to the transcript.

CNN obtained the transcript of a portion of the meeting where Trump is discussing a classified Pentagon document about attacking Iran. In the audio recording, which CNN previously reported was obtained by prosecutors, Trump says that he did not declassify the document he’s referencing, according to the transcript.

Trump was indicted Thursday on seven counts in special counsel Jack Smith’s investigation into the mishandling of classified documents. Details from the indictment have not been made public, so it unknown whether any of the seven counts refer to the recorded 2021 meeting. Still, the tape is significant because it shows that Trump had an understanding the records he had with him at Mar-a-Lago after he left the White House remained classified.

Publicly, Trump has claimed that all the documents he brought with him to his Florida residence are declassified, while he’s railed against the special counsel’s investigation as a political witch hunt attempting to interfere with his 2024 presidential campaign.

CNN first reported last week that prosecutors had obtained the audio recording of Trump’s 2021 meeting at his Bedminster, New Jersey, resort, with two people working on the autobiography of Trump’s former chief of staff Mark Meadows as well as aides employed by the former president, including communications specialist Margo Martin.

The transcript of the audio recording suggests that Trump is showing the document he’s discussing to those in the room. Several sources have told CNN the recording captures the sound of paper rustling, as if Trump was waving the document around, though is not clear if it was the actual Iran document.

“Secret. This is secret information. Look, look at this,” Trump says at one point, according to the transcript. “This was done by the military and given to me.”

Trump was complaining in the meeting about Chairman of the Joint Chiefs of Staff Gen. Mark Milley. The meeting occurred shortly after The New Yorker published a story by Susan Glasser detailing how, in the final days of Trump’s presidency, Milley instructed the Joint Chiefs to ensure Trump issued no illegal orders and that he be informed if there was any concern.

“Well, with Milley – uh, let me see that, I’ll show you an example. He said that I wanted to attack Iran. Isn’t that amazing? I have a big pile of papers, this thing just came up. Look. This was him,” Trump says, according to the transcript. “They presented me this – this is off the record, but – they presented me this. This was him. This was the Defense Department and him. We looked at some. This was him. This wasn’t done by me, this was him.”

Trump continues: “All sorts of stuff – pages long, look. Wait a minute, let’s see here. I just found, isn’t that amazing? This totally wins my case, you know. Except it is like, highly confidential. Secret. This is secret information. Look, look at this.”

“Secret” and “confidential” are two levels of classification for sensitive government documents.

In March, prosecutors subpoenaed Trump for the document referenced in the 2021 recording. Trump’s lawyers provided some documents related to Iran and Milley in response to the subpoena, but they could not find the document itself.

Federal prosecutors have been investigating Trump over the mishandling of classified documents taken to Mar-a-Lago and obstruction of the investigation. Trump’s lawyer said the former president was given a summons by the Justice Department to appear in court Tuesday in southern Florida.

The Mar-a-Lago investigation is one of two being led by Smith, who was appointed special counsel in November by Attorney General Merrick Garland. Smith’s investigation into efforts to overturn the 2020 election is still ongoing.
