Trump Melts Down as DOJ Turns Over Evidence It Plans to Use Against Him

The former president is pleading for Congress to intervene now that he's learned what the government has on him

RYAN BORT
JUNE 22, 2023

Donald Trump fired off a series of desperate pleas on Truth Social, including multiple appeals to Congress to bail him out, hours after news broke that the Justice Department had turned over the first batch of evidence it plans to use against him. The former president was indicted earlier this month on charges related to his handling of classified material after leaving the White House.

“CONGRESS, PLEASE INVESTIGATE THE POLITICAL WITCH HUNTS AGAINST ME CURRENTLY BEING BROUGHT BY THE CORRUPT DOJ AND FBI, WHO ARE TOTALLY OUT OF CONTROL,” Trump wrote Thursday morning.

The former president also dusted off the idea that the DOJ framed him by planting the classified material at Mar-a-Lago — despite the fact that he’s claimed repeatedly that he somehow declassified the material before bringing it to Florida himself. “Congress will hopefully now look at the ever continuing Witch Hunts and ELECTION INTERFERENCE against me on perfectly legal Boxes, where I have no doubt that information is being secretly ‘planted’ by the scoundrels in charge,” he wrote in another post before griping about his other legal woes.

Trump’s indictment is damning, with the DOJ alleging that the former president knowingly took classified documents to Mar-a-Lago, stored them in unsecure locations, and then conspired to lie to authorities about what he was hoarding while suggesting the material should be destroyed. The indictment also outlines a recording it obtained featuring Trump bragging about having a “secret” plan against Iran.

The evidence the DOJ turned over on Wednesday includes more recordings of the former president, described as “interviews” recorded with his consent. It’s unclear what is on the additional tapes. The evidence also includes grand-jury witness testimony — which means Trump now knows who testified against him and what they said — as well as material obtained through subpoenas.

Trump, understandably, seems pretty nervous. “THIS CONTINUING SAGA IS RETRIBUTION AGAINST ME FOR WINNING AND, EVEN MORE IMPORTANTLY TO THEM, ELECTION INTERFERENCE REGARDING THE 2024 PRESIDENTIAL ELECTION,” he added on Thursday morning. “IT WILL BE THERE UPDATED FORM OF RIGGING OUR MOST IMPORTANT ELECTION. LOOK AT THE POLLS – THEY CAN’T BEAT ME (MAGA!) AT THE BALLOT BOX, THE ONLY WAY THEY CAN WIN IS TO CHEAT. STOP THEM NOW!”

Trump pleaded not guilty to all of the charges against him. The DOJ has asked for a speedy trial, and Judge Aileen Cannon earlier this week told both sides to file all pretrial motions by July 24 while slating the trial to begin on Aug. 14. Trump’s team will almost certainly move to delay the start date as long as possible — maybe even until he can retake the White House and appoint an attorney general who will drop the case.

US Senator Chuck Grassley Renews Bipartisan Push To Put Cameras In Federal, Supreme Courts

March 16, 2023

WASHINGTON – Sens. Chuck Grassley (R-Iowa) and Amy Klobuchar (D-Minn.), both members of the Senate Judiciary Committee, today introduced the Sunshine in the Courtroom Act of 2023 to allow the public further transparency into the judicial system by allowing television cameras in federal courtrooms. Grassley also joined Sen. Dick Durbin (D-Ill.) in introducing a bill requiring the Supreme Court to permit television coverage of all open sessions of the Court, unless the Court decides, by a majority vote of the Justices, that doing so would constitute a violation of the due process rights of one or more of the parties before the Court.

Grassley’s efforts to expand the public’s view of the judicial process come amid Sunshine Week, which celebrates the public’s right to a transparent and accountable government.

“The judicial branch has a massive impact on our daily lives and the lives of generations to come, yet few Americans ever get the chance to see inside the legal process,” Grassley said. “Allowing cameras access to the federal and Supreme Courts would be a victory for transparency and would help the American people grow in confidence and understanding of the judiciary.”

Background

The Sunshine in the Courtroom Act of 2023 would grant the presiding judge in all federal courts, including the Supreme Court, the discretion to allow cameras in the courtroom while protecting the identities of witnesses and jurors when necessary or upon request. It also prohibits media coverage of private conversations between clients and counsel, between opposing attorneys, and between counsel and the presiding judge. The bill contains a three-year sunset provision, requiring Congress to evaluate how media access is impacting the judiciary. Sens. John Cornyn (R-Texas), Dick Durbin (D-Ill.), Ed Markey (D-Mass.) and Richard Blumenthal (D-Conn.) are also cosponsors. The full text of the bill is available HERE.

The Cameras in the Courtroom Act only applies to open sessions of the Supreme Court – sessions where members of the public are already invited to observe in person, but often cannot because there are a very limited number of unreserved seats in the courtroom. Sens. Amy Klobuchar (D-Minn.) and Richard Blumenthal (D-Conn.) are also cosponsors. The full text of the bill is available HERE.

The Revolutionary War was started to avoid the British lowering the price of tea.
To be fair, that is an oversimplification of that event. The taxing of tea was one of several things that they objected to being done to them, but mainly it was the idea that they were being taxed without having a say in the matter , or having a fromal say in any of the matters concerning how the colonies were run. It was basically: 1. an item it was easy to get people worked up about, and 2. a thing they could easily sabotage and blame on "the natives".

I will grant you that there are some parallels to be drawn, but the colonists had legit gripes against the crown back then. Republicans also could air their actual issues and cite examples, but instead they make up items that sound as awful and scary as possible just to work up their base.

Trump hit with new charges in classified documents case, third defendant added

Trump is accused in a new superseding indictment with his valet, Walt Nauta, of an attempt to delete video surveillance footage at his Mar-a-Lago club in Florida during the summer of 2022.
A third defendant, Mar-a-Lago maintenance chief Carlos de Oliveira, was added to the case in federal court.

Donald Trump was hit Thursday night with three new federal criminal charges, and a third defendant was added to the case where the former president already was accused of dozens of felonies related to retaining classified documents at his Florida residence after leaving the White House.

Trump, the frontrunner for the 2024 GOP presidential nomination, is charged in a new superseding indictment with his valet, Walt Nauta, over an alleged attempt to delete video surveillance footage at his Mar-a-Lago club in Palm Beach, Florida, during the summer of 2022.

107254413-1686336275159-Trump_indictment_photo6.PNG

The DOJ's indictment includes photos of classified documents found at former President Donald Trump's Mar-a-Lago residence.

At that time, when federal officials were seeking the return of government records they suspected of being kept at that location.

Trump is also newly accused of retaining a classified document detailing a U.S. military plan of attack on Iran, which Trump showed to a writer, publisher and two staff members at his club in Bedminster, N.J., on July 21, 2021.

At the time, Trump had not been president for five months, and his guests "did not have security clearances" to view the document, according to the superseding indictment in U.S. District Court for the Southern District of Florida.

Carlos de Oliveira, the third defendant added to the case against Trump and Nauta, is head of maintenance at Mar-a-Lago.

De Oliveira allegedly told another Mar-a-Lago employee that "the boss" wanted to delete a server containing surveillance footage showing how Trump's boxes had been moved around at the club, according to the superseding indictment.

The new charging document also identifies de Oliveira as the person who helped Nauta move about 30 boxes from Trump's residence to a storage room.

He also allegedly told the FBI he was not involved in moving documents that officials sought, telling agents, "Never saw anything."

New charges

The new charges against Trump include an additional count of willful retention of national defense information and two new counts of obstruction against both him and Nauta.

The new obstruction counts relate to the alleged efforts by Trump, Nauta and de Oliveira to delete Mar-a-Lago security camera footage that was sought by a federal grand jury in June 2022.

107256204-16867013032023-06-13t213931z_844158955_hp1ej6d1lb40a_rtrmadp_0_usa-trump-documents.jpeg

Former U.S. President Trump appears on classified document charges after a federal indictment at Wilkie D. Ferguson Jr. United States Courthouse, alongside his attorney Chris Kise in Miami, Florida, U.S., June 13, 2023 in a courtroom sketch.

With the new charges, Trump now faces 40 criminal counts in the case, which was first lodged in early June by Department of Justice special counsel Jack Smith.

The most serious counts against Trump carry 20-year maximum prison terms.

De Oliveira, 56, was charged Thursday with conspiracy to obstruct justice, altering destroying, mutilating a document, and false statements.

The false statements charge relates to the voluntary interview De Oliveira gave FBI agents in January.

Trump, who is seeking the 2024 Republican presidential nomination, stored hundreds of government documents at Mar-a-Lago after he left office, and according to prosecutors took steps to keep them hidden from U.S. officials seeking their return.

Trump and Nauta have pleaded not guilty in the case. A trial in the case has been scheduled for May, just months before the general election.

John Irving, a lawyer for de Oliveira, declined to comment, according to NBC News.

What's next?

De Oliveira has been ordered to appear in Miami federal court on Monday for his first hearing in the case.

Peter Carr, a spokesman for Smith, said in a statement, "Today, a superseding indictment was returned by a grand jury in the Southern District of Florida that adds one defendant and four charges to the prior indictment filed against Donald J. Trump and Waltine Nauta."

Trump spokesman Steven Cheung slammed the Justice Department over the new charges. "This is nothing more than a continued desperate and flailing attempt by the Biden Crime Family and their Department of Justice to harass President Trump and those around him," he said in a statement.

"Deranged Jack Smith knows that they have no case and is casting about for any way to salvage their illegal witch hunt and to get someone other than Donald Trump to run against Crooked Joe Biden," Cheung said.

Smith separately is overseeing a criminal investigation of Trump related to his efforts to undo his 2020 electoral loss to President Joe Biden. The special counsel last week informed Trump that he is a target in that probe, a notification that typically occurs before the target is charged in a case.

A grand jury that has been hearing testimony and reviewing evidence in that case in U.S. District Court in Washington, D.C., ended a session Thursday afternoon without issuing an indictment.

Trump faces other legal issues. In spring, a Manhattan grand jury charged him with falsifying business documents related to a hush-money payment to porn star Stormy Daniels. In Georgia, meanwhile, a local district attorney is probing the former president over his attempt to overturn his 2020 electoral loss in that state.

I’m rereading the superseding indictment, and details that have been there since the start are still gobsmacking. Among them? That between Jan. 2021 and Aug. 2022, when the FBI conducted its court-authorized search of Mar a Lago, MAL hosted 150 social events.

1/

Those events included “weddings, movie premieres, & fundraisers that together drew tens of thousands of guests.” Safe to say DOJ/Smith’s team obtained the event staff’s records to illustrate why Trump’s keeping hundreds of classified documents at MAL was reckless & dangerous.

2/

Another thing I only appreciated on a closer, slower reading: The Special Counsel has a list of those federal agencies/departments with a stake in the classified documents at issue. They include the Department of Energy. Why?

3/

Because, as the indictment states, DOE is “responsible for maintaining a safe, secure and effective nuclear deterrent to protect national security, including ensuring the effectiveness of the United States nuclear weapons stockpile without nuclear explosive testing.”

4/

In other words, it’s not just that one or more of the documents addressed *other countries’* nuclear capabilities (see Count 5 on page 33); it’s that at least one of those in Counts 1-32 implicates our own.

5/

And indeed, the document at issue in Count 19 is described as “concerning nuclear weaponry of the United States.” 6/Image

Less inflammatory, but still significant are signs of the breadth of the evidence the Special Counsel’s team has. While the indictment has long been chock full of Nauta’s texts, it is easier to overlook direct quotes from texts only involving other folks.

7/

Take the text exchange in paragraph 28, for example, where Trump Employees 1 & 2 discuss in April 2021 where to move Trump’s boxes to make room for a staff office. Whose phone did that come from? Employee 2, thought to be former exec assistant Molly Michael? Or Employee 1?

8/

Similarly, in paragraph 80 — part of the new allegations — there is a text between DeOliveira and Trump Employee 4, thought to be Yuscil Taveras, an IT staffer at Mar-a-Lago. Has Taveras’s phone been turned over, via subpoena or voluntarily, or do the feds have DeOliveira’s?

9/

There are also indicia that while Trump may not have texted or emailed on his own devices, he used his staff’s phones. The employee believed to be Michael tells Nauta via text in Dec. 2021, “I’m sorry potus had my phone.”

10/

Let’s assume Trump used staff phones during his WH years to circumvent WH record keeping and/or avoid certain bureaucratic steps, which are not exactly kosher to begin with. But what reasons could he have for doing so in his post-White House life?

11/

(Addendum: Thanks to my colleague @LauraAJarrett, I learned that the feds seized DeOliveira's phone: ). /9.5washingtonpost.com/national-secur…

The superseding indictment reflects the Special Counsel's securing and digesting a host of other data, including phone records & surveillance footage of even outdoor areas around MAL. But what stands out on a fresh read are the unnamed actors & their potential cooperation.

12/

Paragraphs 39-47 show Trump Employee 2 knew Trump retained dozens of boxes of records & was reviewing some in Nov.-Dec. 2021 for return to NARA. She helped Nauta move boxes for Trump's review & texted with Nauta & one of Trump's representatives with NARA about his progress.

13/

And she even helped Nauta load the first 15 boxes returned to NARA into his car and then a commercial truck on 1/17/22. Shortly after the Aug. 2022 search, news broke that the feds had already been in contact with Michael.

14/

Trump Search Said to Be Part of Effort to Find Highly Classified MaterialThe former president said he would not object to the Justice Department’s move to release the search warrant used to carry out the search of his Florida home.https://www.nytimes.com/2022/08/11/us/politics/trump-fbi-subpoena.html

Yet nowhere in the indictment is she accused of any false representations to the feds about "the location and movement of boxes before the production to NARA," as Nauta has been. In fact, that's the gist of the false representations charge against him in Count 38. 15/

But what's more interesting is *how* the Special Counsel's office determined Nauta lied to the FBI in May 2022. Because although DOJ sought surveillance footage going back to 1/10/22, it only got footage as of Apr. '22, after boxes were moved around for Trump's NARA review.

16/Image

Sure, they quote texts between Employee 2 & Nauta. But some of the allegations could only have come from a witness. How else would they know Employee 2 gave Trump a photo of the storage room boxes "by taping it to one of the boxes [she] had placed in [his] residence?" 17/
