Never stated that the president sets the amount of justices. The president nominates, congress confirms - or in other words can accept or reject the nominee put forth. If the dems control congress and the democratic president puts forth a nominee there is nothing to stop the congress from adding that nominee to the bench. It’s not complicated. Again there is no legal (i.e. constitutional) limit to the number of justices that can sit on the Supreme Court. Geez!!

So there IS a legal limit to the number of justices on the court. That act would have to be repealed and replaced.

Senator McConnell denied Obama a SCOTUS pick. If Obama had gotten his SCOTUS pick, it could have been a 6-3 court with Democrats in the lead.

Because of that, it allowed Trump to get 3 picks during his one term.

Trump would have only had 2 picks during his 4 years, it would currently be a 6-3 court under Biden, with Democrats in the lead and this case would have either been refused or decided in favor of RvW.
