Thanks for the excellent summary and breakdown. I slightly disagree on the sentencing rationale though. Seems like the judge was focused on disparate punishments for similar conduct rather than notice, although I would concede that the concepts are intertwined to some extent. More to your point, the message was "follow your own policy."
Personally, I like the outcome. I'm obviously defense oriented, but I believe that a lot of masseuses, like a lot of murder victims, aren't all that "innocent." When the "victim" list goes from 24 to 4 once you start testifying under oath, one could reasonably conclude that we aren't talking black and white, but shades of gray. Bottom line for me-what they did to Kap still pisses me off. This, not so much.
